Is there any way that I can work outside the state which sponsored me ?

Hello,

 

Is there any way that I can live in another state which had sponsored me if I can't find a suitable job there ? knowing that my points were higher than 120, but I only applied for sponsorship to get my visa faster.

A good question to take up with the immigration department for they are the authority over whether your breach of the visa would be waived.

I was "advised" by a WA "official " at an expo 2 do just that! Apparently once ycu have the visa you can't be "forced" 2 live in a particular state. Not a stress I'd want tho.

Hi Rocky, Long time since I've seen your name on here. Have you made the move to Oz now? There's been quite a few posts on here recently asking the same question. If you've tried & tried to get work & theres none to be had, then I think you will be OK from what others have said. Don't take my word for it though, I'm sure one of the agents will be along soon to give you the correct info. Tread carefully! Lovely to hear from you Roky, & best of luck hun. X

Hi, we have asked this question before and were told the answer is no, definately not. In fact we were told that if you tried to do this you would be tracked down and that they check you are working in the state you applied for, its about six months since i asked this and i think i was told we would be made to leave oz. I am not 100% certain about this, but i wouldn't take the risk without checking with the oz authorities.

I finally made the move to Oz, but it wasn't the great one, I had to apply for ACT sponsorship just to get my visa quickly, but it seems that it wasn't the right thing to do.

 

I'm here three weeks ago, and can hardly find any job vacancy to apply for, all the jobs in ACT require citizinship. So how do they expect me to work in the ACT while I'm a new migrant ??

Are you sure it's not residency?

And with a 176 visa you now have residency

 

If you have got companies or even government departments specifying being a citizen, I would raise that with the entity concerned in the first place re you having residency which in time allows you take out citizenship.

 

If they still stick with citizenship, you might want to look up the government department that handles matters of discrimination.

 

But no doubt you're likely finding a tight job market.

Yes wanderer, I've a 176 visa, but does it mean I can live wherever I want .. even if .. I signed a paper stating that I agree to live in the ACT for two years

 

Actually we can't consider the citizinship requirment as a discriminiation, because these jobs are usually defence or federal department jobs. Secondly, the dept which is responsible for migrants nomination and settlement in the ACT are already aware of this problem, and they claim that there're many private sector jobs availale.

 

My main concern is find a way to get out of this trap that I but my self in.

Hi Rocky, Sorry your having a tough time of it. I know where you're coming from. We were sponsored by WA. We haven't made the move yet as we need to sell our house but, hubby has been looking for a job ( he's on all the recruitment agency books) for 18 months now & only 1 job in his field has come up in all that time!!! They come up all the time for other states but not WA & WA was the only state that had his job on their sponsor list! If you haven't already, have a look at www.seek.com.au & www.macrorecruitment.com.au . Hope you find something soon Rocky, try a bit of cold calling too, you never know. As I said there have been a few posts of late, people asking if they can change state, you'll probably have to go back quite a few pages but have a search for them & see what the agents have told them! If you read your visa grant letter and your visa label, you will note that there are no conditions on your visa at all.

 

You can work in another State if things genuinely do not work out for you in the ACT. The only risk is that the Minister might decide to have a crackdown on 176 holders who he suspects applied for SS purely in order to get their visas quickly but who never did intend to settle in the sponsoring State. He could argue that the person hoodwinked both the sponsoring State and himself, in which case he could consider visa cancellation. You could fight any such attempt and you would probably succeed but it is a stressful thing to have to go through.

 

Several Fed Govt Departments hold sensitive information. Jobs that involve accessing restricted information can often only be given to Australian Citizens. Where sensitive information is not involved the Oz Govt can and does hire migrants and even sponsors them for visas.

 

There was a guy on here not long ago - a Briton - who was headed for the ACT on an RSMS visa, sponsored by one of the Federal Govt departments.

 

Is it realistic for a new migrant to expect to find the job s/he really wants the most within 3 weeks of arrival in Canberra or anywhere else?

 

Would you be able to stroll into the ideal job somewhere else within such a short time? If so, whereabouts are the sure-fire job vacancies in your field of work?

 

I'd suggest caution, my friend.

Section 22 of the Public Service Act deals specifically with the requirement for employees of the Commonwealth Government to be Australian citizens,and as far as I am aware there would be no means of claiming that this is discriminatory.

There certainly are cases where non citizens are able to be employed in the APS and those circumstances are spelt out clearly in the link I have posted.

As to whether a private company can require an applicant or employee to be an Australian citizen then that is something that I can't claim to have a great deal of knowledge about.

From your post, I can understand that there might be some people do work outside the state that sponsored them ... wouldn't this affect their eligibilty when they apply for citizinship four years later ?

 

Actually, I wouldn't work outside the ACT unless legaly entitled to, because I've signed a statment that I commit to live and work there for two years, and this statment was witnessed by an officer in the Australian embassy in Cairo.

 

So, I was wondering if it's possible to make a complaint or appeal, claiming that the state sponsoed my though they really don't have job vancancies for me. In other words, they mistakenly had my occupation in their shortage list though they hardly have any job vacancies for me.

I think it was clear that Visa Grant does not equal Job Vacancy. Same goes, getting positive assessment in a CSL occupation does not equal Job Vacancy.

 

So therefore I don't think they made a mistake by putting your occupation on the CSL. Don't blame them for letting you into the country or blaming them for misleading you into thinking there are ready job vacancies for you to fill.
