Balance of family test - include students?

Hi this is 1 of 4 posts regarding a visa for my parents to join me in Australia. There seems to be lots of options but none of which fit very well!

Basic info is I've been in Australia on a permanent resident visa for 5 years, but have 2 brothers in the uk so the parent visas aren't possible at the moment. My parents are 55 which makes permanent working visas very difficult.

One brother would love to move out here but is short of formal qualifications. Instead of training in the uk to get enough points it would seem sensible to me to train here on a student visa and then you don't need to worry about the converstion of qulifications etc.

If he did this does anyone know when he would pass the balance of family test? Also, I thought I read somehwere (but can't find now - too much information!) that the balance of family test is determined at the date of submission and not reevaluated when you finally get to the front of the que. This would seem sensible (which counts for nothing I'm sure!) as things could easliy change in the length of time it takes....

The balance of family test must be satisfied at the date of visa application and at the date of visa decision. There have been cases where a relative in Australia had died and the visa applicants could not longer satisfy the latter condition.

I think Vivien is asking a different question from the one you have answered.

 

It seems to me that Vivien is trying to "feel out" the situation which Alan Collett of Go Matilda described in this article:

My own feeling is that a subclass 487 visa should be enough to get the idea of ignoring Vivien's brother off the ground:

 

Skilled – Regional Sponsored (Provisional) visa (subclass 487)

 

I don't think a Student Visa would be enough. I think it leaves too much doubt about what might happen after the student visa has come to an end.

 

If the Student has graduated and has obtained PR via the sc 885 or 886 visas then there is obviously no problem with launching the Parent visa application the next day. If the Graduates' next visa is a 487 then this is the onshore version of the scenario which Alan describes.

 

What about if the Student graduates and moves on to a subclass 485 visa next, though? Could one launch the Parents' application soon after the grant of the sc 485 visa, I wonder?

 

I know it is purely academic because Vivien's brother hasn't even identified a course to study as yet but I would be interested to know what you think, please? How far do you reckon this boundary could be pushed? I don't know. That is why I am wondering just what the possibilities might be.
