Guest Woody
Hello! We have just had our TRA accceptance letter and so are now onto the next hurdle - the vias application! Was wondering though - is there a time span that you have to enter Oz once your vias has been granted? We need to build up our money and so don't want to start too soon if we then have to get over there before we can afford to move. We are applying for the skilled 136 visa if it makes a difference. Guest Gollywobbler
Hi In theory you can wait till the 5 years is almost up before you make the permanent move to Oz, but doing so can play havoc with the conditions for eligibility for a Resident Return Visa. Please see here: http://www.immi.gov.au/migrants/residents/155/index.htm Once the initial 5-year travel period of the first visa expires, everybody who has not already become a Citizen needs an RRV if they wish to leave Australia and then get back in. Most people will still have family back in the UK (and might want to leave Oz for a holiday even if not.) Therefore I reckon one is well advised to ensure that in planning when to make the permanent move, one is not going to fall foul of the RRV rules in any way. The Broughtons
I have also been advised that you need to spend at least 2 1/2 of the 5 yrs in oz or they will say they won't renew your visa.

For a 5-year RRV, it's two out of five years as a permanent resident - this is the law as it stands today. Peter
Guest Gollywobbler
Hi Peter If something goes wrong with the plans and the person doesn't manage to spend 2 out of the 5 years in Oz, how do the 3-month RRVs work, please? Are they easy to get if, say, there is a family crisis back in the home country and the person really must be allowed to leave Oz for a while? Thanks Gill

Gill, Each 3-month RRV (subclass 157) application is assessed against a set of requirements. I wouldn't publicly announce that it's an easy-to-get visa, and I strongly recommend against counting on obtaining a 157 as part of an overall visa strategy. The issue here is not about allowing someone to leave Australia - the days of chains and collars are over (for those of us who don't live alternative lifestyle that is) - it's a matter of preserving one's Australian status. Generally, where a compassionate reason exists, the 157 is a possibility. However, the general advice is to not take the 5-year grace period to migrate to Australia on a permanent visa too literally. Things may happen in life to wreck even the best laid-out plan. Peter
