Hello Gill

 

:err: When you say "decision ready" does this mean it would be granted with the minimum of fuss unlike some of the other visa applications? Apologise for this question I am doing as much research as I can.

Alan Collett of Go Matilda is a highly respected Registered Migration Agent with a very busy practice so I should think they handle quite a few 457 appliications. I don't recall seeing any comment by Alan (a regular contributor to several forums including this one) about how the new system is working, whether it is delivering what was promised for it and so on. Since he has not said anything, I assume it is working OK in which case the processing should be fast-track I would guess, since that is/was the idea.

How are occupation points awarded on the points test?

 

If your nominated occupation is on MODL either at the time your application is lodged or assessed, you will be eligible for 'occupation in demand/job offer' points on the General Skilled Migration points test.

Thanks for this. I thought - as you do - that one can trust what the DIAC website promises about MODL points. However Alan Collett of Go Matilda is an experienced Registered Migration Agent. This is what he has said about it all:

 

Can I confirm that DIAC's past practice has been mixed - on some occasions when occupations have been removed from the MODL the entitlement to MODL points has been on the basis of the MODL when the application was submitted, while on other occasions the assessment has been on the basis of the MODL when the assessment was carried out by the case officer.

 

I am happy to be corrected, but technically I believe the entitlement to MODL points should be based on the MODL at the time of assessment

 

 

I would think there would be absolute uproar if DIAC were to try to go against the assertion which they have made on their own website.

 

Then again, their last website claimed that people who were prepared to chip in a 12 month investment of $100K could buy themselves an extra 5 points towards one of the old subclass 136 visas. The money was to be deposited in one of the State Treasuries for 12 months. The scheme came a cropper because all the State Treasuries pulled out of it during 2007 so there was nowhere to make the investment. It transpired that there was no contract between DIAC and the participating States and so the State Treasuries were quite entitled to pull out of the scheme. Over a year later there is no resolution of the problem and some 4,000 visa applicants remain completely stranded.

 

Because of that the Agents are (justifiably) twitchy about how exactly DIAC will interpret whatever the legislation says about MODL points this time around. In Q14 & 15 of the new FAQ they have not addressed the question about what they plan to do about existing MODL points if they change the MODL.

There are strong rumours that they might take Hairdresser and Cook off the planned new MODL. There is a row going on out in Oz about Hairdresser and Cook (please see my reply to ssanick above.) Personally I doubt whether Floor Finisher would be on a new MODL, too. If they take these people off the MODL and deny them the MODL points that many of them are relying on for their points totals, I think there would be litigaton about it. However litigation never solves anything quickly or cheaply.

 

The Minister has said cosily that his new scheme might well have the 'incidental result' that the skilled migrant intake for 2008/9 might not reach the 133,500 ceiling set for it in May 2008. Industry across Oz is insisting that the full quota of 133,500 new skilled migrants is needed. The opposing team are screaming that Aussies' jobs are at risk and allege that the only reason industry wants the new migrants is to force pay bargains downwards.

 

The Minister is hiding in the shrubbery trying to keep both sides happy as far as I can work out. He refuses to be seen to cut the quota. He also seems determined to ensure that the ceiling is not reached. If he has legal scope for skulduggery with MODL points, he might try skulduggery. Skulduggery on this front would certainly help to ensure that the quota ceiling is not reached in the current year. Nobody knows which way this man might tell DIAC to jump. That is the big worry, I think.

Well been on the phone to my agent first thing this morning and he reassured me that as I have already lodged my visa and I am still on the Modl list, they have to honour your job and the points as it came into force after the lodgement, so if they take hairdresser out of the modl list I can still be eligble to go!!!

Hey there,

 

Greetings from Ireland. Does anybody know if Irish/Uk/US/NZ passport holders automatically qualify (in the same way they are exempt) for the test to be deemed to have the English language competency, and thereby get priority processing

PS Also anyone any idea what the prospects for a well experienced (10 yrs post qualification) Accountant with public sector experience would be like, particularly in WA

 

 

Accountant -- where the applicant has achieved a score of at least IELTS 7 in each of the four competencies, and/or has completed The Professional Year

Computing Professionals -- where the applicant's specialisation is listed on the Migration on Demand List (MODL).

My agent is not too optimistic about VIC granting me State sponsorship now that my occupation has dropped from their eligibility list, but I will keep all fingers crossed that they do. I still see loads of jobs in my field in/around Melbourne, but the State might think otherwise.

We received the notification today of the new priority listing announced and its great news as my other halfs skills is listed- Carpenter

 

Does anyone know who much this will speed up the process and we have just sent off vetesses to our agent in oz.?

I take it your other half has done the practical assessment through Vetassess? My husband is also a carpenter and we are contemplating a move to Australia. We've done the competency profile and the next step is the practical assessment...hubby was interested in hearing what other people's experiences of the test were ie what type of questions do they ask, what are you expected to do, is it a full 2 day interview?

 

I hope you don't mind me asking :)

CSL update

 

Hi,

Can anyone tell me what 'IELTS 7 in each of the four competencies' means? I googled it and got 'International English Language Testing System' is that right?

Hi Smiles

It's an internationally recognised English test comprising of reading writing listening and speaking.

For immigration purposes you need to take the general test and get a pass mark of 7/9 in each area. Costs £105 and takes a day. Results in 10 days. Valid for 2 years.

Would I still be required to take the test holding a UK passport?

 

Also if you have a moment could you look a couple of my other threads, in particular the police checks.

Hi,

 

You are usually not required to take the test if you have a UK passport you will receive 15 points for English ability. If you take the test and get a "7" score then you get 25 points so it depends on whether you need extra points for immigration and sometimes on your occupation. Google search websites on points tests for Australia as they tend to give info about it.
