twinsmom65 Posted October 3, 2008 Posted October 3, 2008 Well as some of you may know, our house deal did not close, our buyer pulled out 3 days before exchanging keys. Unheard of in Canada. I have the right to sue him for breech of contract, but seeing as we are leaving in 2 weeks we decided not to pursue legal action. Well it has been a week from hell, we now have the house back on the market, it is completely empty. Got a few touch ups to do, but should be all systems go for an open house on Sunday. We are trying to scrounge up some money so we can go down to Australia with at least something. We were counting on the equity from our house. To tell you the truth, I don't think it has hit me yet that we leave for a new life in 2 weeks. Have been so stressed this week with trying to deal with the house, that I haven't even thought about Australia. I don't think it will hit me until we actually land there, just way too busy at the moment with other things on my mind. The only bright light at the end of the tunnel, is that we are still in the fall market for our housing here in Canada and things are selling under $300,000.00. Also my mortgage company was very understanding and we don't have to make any mortgage payments, just incure interest costs. So even though we have had a week from hell, I do believe things will turn around, maybe not quick enough for us when we leave, but hey you do not have to be in the country nowadays to close a house deal. Well that is my lovely saga from Canada... Roll on Australia !! Karen

Our buyers in chain want to move in two weeks time but the contracts have not yet been exchanged and I have not even got any flights or international removers yet. Caz

Caz Hi Caz, The housing in Canada is alot different than the UK. When you firm up a deal and withdrew any conditions at that point in time you are in a legal and binding contract. The chances of a house not going through in Canada 3 days before the exchange of keys is very rare approx 99.99 % of all deals close fine. Everything would be at the lawyers office a week before closing. People have pulled out of deals, sometimes six weeks before closing, however, because they are in breech of contract they are subject to legal action. Most homeowners do sue people if they go in breech of contract. So for us to book our flights was a non issue as like I said 99.9% of deals close on the day. I have never heard of anyone pulling out 3 days prior due to non financing. This is all taken care of prior to firming up the deal. The house will sell, it sold in a week previously, just gonna check out everyone's credit scores from now on LOL I am not too worried, I'd rather be in Australia and working than stuck here in Canada during the fall and winter waiting for a house to sell.
