Hi everyone 

they finally opened my file after 3 years and 4 month and they have asked me for a organisational chart and I wanted to check if anyone did it before and if we should write down employer names in it or just the position and visa status

plus I applied as a cook and I got the head chef position after 2.5 years and will it be a disadvantage for my visa as I applied as a cook

It was such a lengthy and stressful period that it affected to my mental health and almost gave up end of the day for many reasons as many here might be in the similar situation: family, covid pandemic, the ridiculous reason that Home Affair refused our case and so on. 
 

However, every cloud has silver ligning. I did have countless support from family, local community and you guys here who had given hopes and empathy. I am thankful for those who have shared their cases and advice. 
 

Below is some tips from me:

- If you are still waiting so your case will be opened by AAT, please follow the statistics from their website which for me gives you the estimated waiting time. You might also check the updates from people here with their timeline. I believe it is helpful to give you an idea where your case is. Therefore it does get yourself well-prepared, saying police clearances, passport (if that expired or about to). For example in November 2021, i had kept following this forum and AAT website and acknowledged that i might have to wait roundabout 30 something months. Considering during the pandemic everything does take time, in January i did apply for passport renewal ( as it would be expired soon) and police clearances both AFP clearance and oversea one. I also asked the accountant of our business to get our financial records updated such as BAS, income tax returns, payroll reports… i mean as much as possible with regard to the operation of our business. If you follow this website, you definitely can have some ideas what sort of documents that AAT might require base on the refusal. In my case, they asked: Business registration and history from ASIC, updated Quarterly BAS for September, December quarters, financial reports for 2020 and 2021, organisational structure, my job description/duties, updated employment contract, the prove of regional body certicate, prove of job advertising back in 2017 when i applied to job and 2 more minor things. When we received this letter from AAT to request documents, we had already got almost everything!!!!

- Health check appointment does take time. When we received the S56 for health check, we tried to book the appointment but it took us 1 month. Not many appointments were available and again Covid sucks! With this point, i mean that you might try to save your health check appointment as soon as you could. I wasnt sure if you could do the health assessment before S56 sent out considering It is valid 12 months. Again, i am unsure. 
 

- immi account: This is highly recommended. As visa applicant, we can create our immi account eventhough our visa application is lodged by agent. You then can import the application and track it. From there you can see the status, updates, messages and attachments. You can also see what documents you or the agent has uploaded. At this point, after the health check cleared, what we found was my partner’s oversea police clearance was missing which we thought it should’ve been in before ( as we provided everything when s56 was issued). I then contacted to my agent and he did attached it again, so not sure if he forgot or due to some technical issues. Anyway my point is immi account gave me the access to see how my case was and check if the requested documents have been submitted.

- last but not least, as many say, live your life, stay positive. I know said is easier than done especially for us who (used to) desperately wait for our golden day. You still have your family, your work colleagues, your community who are always with you. If you find it difficult to express your feelings while you hopelessly wait, then reach out councillors, specialists. I am sure they are willing to help you out.

Deadline for document submission was 1 Nov. Hearing (scheduled for Tuesday) got cancelled and the nomination decision substituted today.

Waiting to hear back from Immi now for the medical check and individual visas.

Hi all,

AAT set aside and approved my nomination a month ago, remitted my visa for a review to immigration, since then nothing heard, but my concern is that checking on immiAccount the status didnt change from before and still stating as "finalized". Any of you got an idea of whats going on? is the case still not allocated to any case officer at the department? or under any investigation? or could have been lost on the way to the department? what the status is supposed to turn like once it gets on a case officer hand?

Don’t stress too much mate as department can take longer to finalise the application after AAT remittance, as mine took around 4 months to allocate a case officer and 7 months to grant.  So just be patient and get ready your pcc etc.

7 months from remittance or from allocating a case officer? 😳

Also, does anyone know if the process is faster if the decision is substituted, not remitted?

Also my nomination has been approved by AAT, but the visa was remitted for a review since we need to provide addictional documents as AFP and medical, which AAT is not entitled to ask, and eventually asking for employer letter stating position available for the next two years. Check your immiaccount and see whats the status like, mine is still finalized and hasnt moved from there, @Paul0015 is correct, immi sometimes takes time to allocate it, but lately many cases have been processed in just few days, my friend won aat in may and got immi s56 in july, two months later, and received his PR in august, totally 3 months. I have no idea what this would depend from, maybe different state office and different work loads and time frame, or some officer is just negligent and takes time, but we can only wait.

Understood, I too am talking about the nomination decision. It can be remitted or substituted, unless affirmed, so my question is was your nomination decision remitted or substituted.

Not talking about individual visas (PR).

I heard that substituted decision are fast-tracked to and by Immi.

My nomination was substituted by AAT, and approved.

I think my medical was sent and approved on 20/9/22 but doesn't matter, they wait 28-30 days usually after requesting documents. The CO who requested my documents and the one who approved my visa is different.

I think waiting long or not depends on your luck as well. There are no systems in immi

Your occupation? It's a bit long to wait for a month, but I did see some people got requested 2 months after AAT. They will first approve your nomination, the email will be sent to your agent/you. Then they may request medical/pc as well on the same day, which is my case.

Your occupation? It's a bit long to wait for a month, but I did see some people got requested 2 months after AAT. They will first approve your nomination, the email will be sent to your agent/you. Then they may request medical/pc as well on the same day, which is my case.

AAT Question! 

My 187 visa was refused in October 2019, I applied to the AAT in November 2019. It has been 36 months. 

I was wondering if anyone else had a similar time line and have heard anything about their appeals?

187 refusal lodged aat in July 2019 still waiting, state Qld

Current estimate processing time shows in aat website is 3 years 6 months 😭
