Hey, 

ive just submitted my EOI for my 190 skilled visa. Does anyone know on average how long it takes for the government to review this? I’m a bit confused with the difference between the Expression of interest and the State nomination application and how these impact each other?

Right now, who knows. It’s all different due to Covid

Even in normal times, I would recommend you use a migration agent. These are very not normal times. There are very few approvals for visas at the moment.

You make the state application when and if the state picks up the EOI.

What's your ANZSCO code? Which all states have you applied for 190?

Also, 190 program is currently closed now and the states will start sending out invites only after they receive the Annual Migration Quota from the federal gvt which is scheduled for 6th Oct, 2020. Having said that, some states have updated on their websites, that until they receive the quota, they might send out few invites only to occupations critical/relevant to the economy during this pandemic. So, if you are from a critical care occupation, you might expect some movement soon. If not, it will be a long waiting time for you. 
In addition to that, states invites people whose skills are in need of the particular state and high points do not really matter much. They can invite someone with 70 points and not invite one with 95 points.

Answer to your second question: Applicant files for state nomination application when their EOI gets picked by any/particular state. However, for some states and occupations (example-VIC for occupations OTHER THAN ICT, Nursing & Engineering occupations), one can submit 190 EOI and can simultaneously file state nomination application and the state will process the application and will declare the outcome-accepted/rejected/refused.

I do have a visa agent working on my case but am still finding things a little confusing! She summited my EOI yesterday but said the state nom applications are currently closed so I’ll hve to wait until my EOI is accepted? I’m confused about this part - does the state acknowledge my EOI and tell me I’m okay to apply for the visa then I also hve to receive an invitation from the state? I’m applying in Victoria as a primary school teacher btw 🙂

From memory it's quite straightforward if you think about it one step at a time

Step 1: Submit your EOI (this informs the state you've chosen that they have an EOI they can look at)

Step 2 : WAIT - until the state decide to offer you the chance to apply for sponsorship nothing will happen you just stay in the EOI queue

Step 3 : Either you wait 2 years with no communication and it times out or, at some point the state gets back and asks you to apply for sponsorship

Step 4 : Fill out the sponsorship form, retunr it and wait 2-4 weeks (depends on state) whilst they decide to offer sponsorship or not

Step 5 : They write back either declining to sponsor or offering sponsorship. If they offer sponsorship they also send a unique link to the Immigration Portal for you to start your VISA application

Step 6 : Fill out you visa process and wait for IMMI to send that all important grant letter

 

 

The key difference between a 190 and 189 in terms of processing is that with a 189 it's a strict queue. The highest points (with the longest wait period in that point tally) gets the next invite to apply. With a 190 it almost doesn't matter about your points it depends on if the State wants your profile. Many states are less interested in 90+ points and more in superior english or Master level education or some other such criteria (which they don't publish). So a decent agent can give you a "rough idea" of how long your case may take to be selected, but it's just that an estimate there is no timeline guidance for a 190 EOI
