RRV application advice - how likely if I only have employment

Hi all

I'm not sure at this point if I need to engage a migrant agent to help me so if anyone been in a similar situation I would be grateful to hear from you.

Background:

My PR expired last year while I'm offshore and I'm still am now 2-3 years ago, I was working in Brisbane for a few months but had to return home due to family issues.

Currently, I'm trying to convince a prospective Aus employer into hiring me and its very close. I'm looking into applying for a RRV 155. My situation is I do not meet the 2 out of 5 years PR time in Australia, so the best I would get is 12 months RRV, from my readings. By just an employment letter alone and without other substantial ties, how likely would I get the RRV approved? I would have to do all the applications myself and currently the employer is awaiting for an answer.

Thanks much.

We’ve seen cases where a solid job offer has been enough, but I would play it safe and hire an agent to do the application. They know how to word things to satisfy Immigration.

I agree with this ... these types of application are very specific to the circumstances of the applicant.

Last August I applied for an RRV on behalf of my wife (who has PR) because her initial 5 years would have expired before we were able to return to Australia. Fortunately I'm an Australian citizen so we were able to put in her application that I was returning to live and work in Australia, and of course I wanted my wife to be able to join me. In this case it was sufficient to meet the substantial ties criteria without providing any further evidence. I sweated about it as I didn't have a job offer at the time but it ended up being a formality - they granted it in about 3 days. I wished we'd applied for it a bit later in the year as it would've given my wife a bit more time to get over here, but that's another matter! I believe the fee was about $400. Anyway, that's my experience for what it's worth.

I agree with the advice of others that you should consult a migration agent as it sounds as though you don't have much to back up your application. I would also think about the reasons why you couldn't have come back sooner, because if you had compassionate reasons then that could also work in your favour.

Good luck, and I hope you make it back.

The fact that she's married to an Australian citizen counts as a substantial tie, so you had that advantage over the OP.
