Casual construction labour injured at work, what's our rights?

How long have you worked there? 
You can apply for work cover as a casual you need to get your GP/Specialist to complete a form similar to the one below (this is for Qld) https://www.worksafe.qld.gov.au/__data/assets/pdf_file/0007/77119/form-132m-work-capacity-certificate-workers-compensation.pdf

I am not sure which state you are in but these are the state specific sites you want.

Australian Capital Territory (ACT) — worksafe.act.gov.au

New South Wales (NSW) — workcover.nsw.gov.au

Northern Territory (NT) — worksafe.nt.gov.au

Queensland (QLD) — workcoverqld.com.au

South Australia (SA) —workcover.com

Tasmania (TAS) — workcover.tas.gov.au

Victoria (VIC) — worksafe.vic.gov.au

Western Australia (WA) — workcover.wa.gov.au

In regards to rights/payments etc

They can average the amount of hours you have worked there, so if you have only been there a month you would a smaller payout than if you had worked there 12 months plus.

Here are the two categories of compensation payments:

Weekly payments — payment(s) to employee as compensation for loss of income resulting from the work-related injury/illness

Medical expenses —any medical/hospital cost that arises directly from the work-related injury/illness

A member of the forum had a work related accident, he had been with the company years. Work Cover have been absolute arseholes (excuse my French) with him, he has had 4 independent specialists (gov and private) tell him he needs surgery, yet work cover told him he didn’t. 
‘We also had another member who had her wrist broke after a patient attacked her, she was a nurse, she was left with severe complications and again Work Cover made her jump through hoops.  
 

Good luck and I hope you recover from your injury.  I would definitely make sure that you make a record of it, even if you do decide not to claim at the moment.

Thanks for your info, very helpful.
We are in QLD.

I asked for my hubby, he was minor injured at work ( six stitches on his wrist and since been out of work for two weeks) today his boss phoned him only see if he would be back to work again. Not mention a word about the pay for these two weeks.

His employer is a sub contractor. I presume he is self-insured. Will my hubby be covered by his boss's insurance company or workcover is the only way to go? Thanks

To be honest, personally, I wouldn’t claim. It is a lot of paperwork, upset and hassle and would probably cause your husband to lose his job.

‘How long will it be before he can work again?

I wouldnt go the workcover route for the sake of 2 weeks wages!  

1. It takes forever

2. On a lot of jobs one of the questions they ask is if you have ever claimed for Workcover, think it makes a difference to whether you are considered or not!

Is that employer's liability to pay for the days he missed due to his injury?

If he is casual he will not be entitled to sick pay. Is there any other jobs he could do at his workplace until his hand is better? so at least he is earning?
