Confused by new partner points

Hi, I am a bit confused by the new partner points awarded..so I've submitted a new EOI today, it added 5 points as my husband has a UK passport and I put in his DOB (Over 45), it added the extra points but then said something about confirming is under 45?!..does this mean we are entitled to the points or not?

One of the conditions is under 45 I believe

There is no age barrier for the 5 points for “partner with competent English”:

6D113

The spouse or de facto partner of the applicant (the primary applicant) (a)  is an applicant for the same subclass of visa as the primary applicant; and (b)  is not an Australian permanent resident or an Australian citizen; and (c)  at the time of invitation to apply for the visa, had competent English

Do you have to do one of the English tests to prove competent English in order to claim the points

Yes (IELTS 6 equivalent score) UNLESS you are a citizen of United Kingdom, the United States of America, Canada, New Zealand or Republic of Ireland, in which case you get a free pass.
