ptnvisa Posted July 9, 2019 Share Posted July 9, 2019 I'm about to apply for my 820 (onshore), with the recent law changes I've got the following questions of anyone knows (the online articles are all out of date). I'll be applying while on a 457. Is still still possible to get BVA? If so, what are the usual work conditions? If BVA is available, will it be cancelled if my 457 is cancelled? If so, can I quit, leave the country come bas as a tourist then apply for the 820 and get BVA with full work rights after the ETA tourist visa expires? Does my Australian partner need approval to sponsor me? The immi website does not detail how this process works We can evidence a relationship of at least 2 years, we have joint finances, a baby, a step child and a mortgage all in Australia and I am from a low risk country. Would this likely lead to our application being 'fast tracked' and can I progress straight to 801 I'll likely consult an immigration agent next week, I'm doing my research first though. paulhand Posted July 9, 2019 Share Posted July 9, 2019 The law (assuming you are referring to the sponsorship changes) hasn’t changed yet. Your questions: 1. Yes you can and there are nil work conditions. Get some tailored advice on your 457 strategy- that is not something to take forum advice on. 2. Yes - at the moment it’s embedded in the visa application process. 3. No ‘fast track’ exists, but you may be eligible to get the 801 immediately. The immigration department were supposed to be requiring that the sponsoring partner is approved as part of a seperate application first and that the BVA visa will not be granted to onshore applicants anymore. The laws were supposed to come into affect April 2019 but were delayed so it was assumed they would be in place by June 2019 as that will be 6 months after royal ascent which is the legal maximum you can wait to implement new legislation.
