The nomination refused yesterday and I have two options. 1. withdrawal 2. appeal after 28 days I waited 19 months and I really expected my visa going to be approve this month. However, I shocked with this result. My agent recommend me that I choose option 2 because it will be success that if company appeals after 28 days. But he doesn't say how long does it take. "If you do not respond to this letter within 28 days and the application has not been withdrawn then the application will be refused. If your application is refused, the department will notify you if you are eligible for merits review by the Administrative Appeals Tribunal. You will not be eligible for a refund of the VAC following refusal of your visa application." And there is no specific reason in the letter. It is an invitation to comment on your visa application, as the associated nomination application has been refused. This letter will not detail why the nomination was refused. You need a copy of the nomination refusal for that. As you are using an Agent, I suggest that you insist to have the situation explained carefully, as it is complicated. The letter regarding the nomination refusal, including the reason for refusal, would have been sent your employer or the migration agent acting on their behalf. You will need to wait to hear from them regarding this, but they should explain the reason and advise whether they will appeal. What you have received is a letter advising you that the nomination has been refused and giving you a chance to comment before they also cancel your visa. Without an approved nomination, your visa has no chance of success so you can only wait to hear what your employer/agent says. If they will appeal the nomination refusal, you may be able to reply to immigration about this and asking that they hold off making a decision on your application until the appeal has been heard.
