I'm finding it difficult to find the information I'm looking for. I'm currently knocking on the door of 40 I'm English born and bred but my father is Australian he came over here with my brother who is also Australian by birth and my mother who is British. My father returned to Australia over 15 years ago. So basically do i qualify for citizenship by descent even if he lived in the UK at the time of my birth he's always remained an Australian citizen. Can i apply for dual nationality and what if any rights would that give me in Australia. After a recent visit to see him with my own family. I'm finding an urge to be with him and my extended family getting stronger and stronger so I'm looking at all options. Any help, advice or clarity would be very much appreciated. Toots Posted January 29, 2019 Share Posted January 29, 2019 Looks like it you are eligible though I would query the word 'may'. If you were born outside Australia on or after 26 January 1949, you may be eligible for Australian citizenship by descent if at least one person who was your parent at the time of your birth was also an Australian citizen at the time of your birth. Parley Posted January 29, 2019 Share Posted January 29, 2019 You should be fine to apply for it. It is not automatic as it is with the UK, so you do need to apply. I also understand if applying as an adult you need to do a police check so they could theoretically refuse it if you have a criminal record. Yes he is didn't move to uk till he was close to 30. I've got no criminal record so that's covered thanks for the replies it's nice to get some reassurance on a somewhat confusing issue.
