Employer nomination refused

Hi there

My employer nomination has been refused saying that my position as a chef is not genuin and case officer is not convinced and refused straight away without any further documents needed.

My MA now said that once the case officer decided it cant be reviewed but only way is to appeal...is that correct?

Case officers do not decide whether a decision can be reviewed. This is legislated.

Case officers advise applicants about review rights, sometimes incorrectly.

As a rough guide, reviews are possible if you applied for a visa in Australia and have remained in Australia, or you were sponsored.

Thanx wrussell for your response. ..so you mean to say that once the nomination is refused you can request for review or you need to appeal to review!!?

If a prospective employer is in Australia then, for a limited time, a merits review of a nomination refusal is available.
