Jared Collins
Hi All We submitted my 186 nomination in March 2017 (when I was 46 years old). Then new Visa/Law changes come into affect in July 2017. (Changed age limit from 50 to 45). My Nomination was then approved on 6 Sept 2017 after the age limit was changed (with no footnote / mention that I was now to old to applying for a 186 visa - even though the approved nomination had my date of birth on it). We then submitted my 186 visa in mid-Sept 2017 (thinking we were grandfathered into the old age limit of 50). Plus paid $10,000 fees. My 186 Visa was then denied in January 2018. They said I am now to old (47), now over the NEW age limit of 45. Totally unfair - because they changed the age limit in between the 2 part process. My new company done all the paperwork, they have had 4 precious 186 visa’s approved - by putting in nomination first, waiting for approval and then putting in application with fees after. What are the chances of getting this overturned by appeal ??

Jared Collins
I know. Nightmare. Immigration have said we can appeal for refund on fees and win, but unlikely to get refusal overturned
Guest
Have you sought advice from a migration agent?
MaggieMay24
Was this through TRT stream or DE? If TRT, they should have allowed the visa, but if it's DE I think you're out of luck. I'd contact a migration agent to see what your options may be.
Fida
After reading tragic note from Jarred, I'm confident that Immi does wait or delays processing just to let applicant cross those age limits that eventually affects visas or reduce points...SO Pissed off!!! Don't play this games with people's life, Just be Frank about your intentions to KICK us Out.
