laf Posted January 9, 2018 Share Posted January 9, 2018 My daughter has applied for citizenship by descent (her father is a citizen by birth). Everything has been accepted except that she is under investigation for fraud. No conviction has been made and she has been told it could take months or even years for a decision on whether she’ll be charged or not. She has been given a month’s extension to submit the UK police check to process the application. However the investigation will of course be flagged up. I’d like to know – a) whether after this extension expires, will her application be scrapped and she will have to submit and pay for a further application when a verdict is made? b) can she presume she will not be accepted for citizenship if convicted? Raul Senise Posted January 9, 2018 Share Posted January 9, 2018 A conviction does not automatically mean that the Citizenship application cannot succeed, however, it will be difficult to meet the Good Character provisions while an investigation for fraud is pending. If she is convicted, it would make it difficult to meet the Good Character provisions on such fresh charges, although it will depend on many factors such as the seriousness of the crime and penalty given. This will mean that her citizenship application extension will expire.
