Hi guys,Ā
Congrats to everyone who had their pr!!! I just had a call from my migration agent. She told me that The department has asked us to do medicals again. Last time we did medicals was 2 years ago so they have expired and we are about to do it again (me and my husband). Hopefully after this we will receive an answer ????

Hi guys, We applied for 187 visa direct entry stream/marketing specialist. We lodged all the papers with regional approval on 12 March 2017. We live in QLD, Sunshine coast. Anyone lodging for the same occupation in the last 2 years and willing to share some info? We are a family of 5 (2 kids going to school and 1 to kindi) and school fees present a big expanditure. Anyone tried to call the immigration office to enquire on their case? What was their reaction? Any info would be much appreciated.Ā

Cheers

Petra

Hi Petra,

I've applied 187 direct entry/ marketing specialist in June 2016.Ā

No news so far. I wouldn't be calling the immi as it's a waste of time... I've called sooo many times and they are helpless.

Just keep your documentation up to date on the portal... when you see that something is about to expire, like a police check, etc, just do a new one and upload it.Ā

Unfortunately, you are not entitle to some Government support while onĀ  bridging visa. I guess that includes financial help for the kids. =/Ā

Hang in there...Ā

Hi guys

I have been seeing you guys discussing about visa and stuff here closely, Wasnt active for some reason.

My nomination got refused as a Restaurant manager after 17 months of waiting period in south australia.

Reason from immi: Since the owner is involved in the restaurant and he is responsible and taking all the big decisions so this restaurant doesnā€™t need a manager. Immi claimed that applicant is a day to day manager which doesnā€™t meet the requirement of being a manager.

My employer is going for AAT, my MA said that immi refused it deliberately just for messing up they couldnā€™t find any other discrepancies so they refused with this reason.

This isnā€™t true guys my owner hardly even comes to the restaurant for visit im the decision maker in the restaurant, no one is my head there.

My question is guys, Do you think is it easy to win a case in AAT if we prove our point?

This was totally bullshit! They are refusing based on assumptions. Finger crossed for all of you!

Go for it, the reason is totally nonsense and unreasonable. Since they can't rely on the "supervisor" like retail manager, they try to create another assumption. You can definitely win this case, find a good agent as well.

Don't give up, I'm starting to worry as well because my case is exactly the same as yours. There is no information stated that the owner cannot work in the workplace, and even if they do, they can't assume that owner is the manager.

I'm sure that your case officer is the same as this member's case officer.

Quote

Hello,

Just before Christmas, the Immigration department has decided to send me a present: after a wait of 18 months, my nomination has been refused.
The occupation is Retail Manager in a coffee shop (no kitchen, no chef, just reselling of products) in regional WA.

The case officer refused without asking for further information and he based his decision on the assumption that the owner works at the shop (not true) and therefore I am not a manager but only a supervisor as the owner as the final decision on important matters of the business such as product mix, pricing, marketing and budgeting (so he thinks).Ā

This information does not appear in any document. We were very careful and the organisation chart clearly shows I am the person in charge. My job description is completely in line with all the duties of a retail manager but for some reason, the case officer believes that the owner is present at the shop part-time (can't explain why). My only doubt is that my employer signed all the documentation with the title "director" (it is a company after all with 2 investors) and that might have misled the case officer. Rather than this, we have received no phone calls and no inspections.

My employer has said that he wants to appeal. We have so much evidence already collected that proves he does not cover the above functions but it is only me. That shop was at a loss when I came thanks to the incompetence of the previous manager and in less than a year I made it profitable by implementing a different strategy and a shop transformation. It is so unfair!

Has anyone been in my shoes? What happened with the appeal? Did you have to wait for the hearing or did you resolve the matter before that?

Any information might help to lift my spirit before these holidays!

Merry Christmas!

Oh what a coincidence, this is exactly the same situation as mine, have you heard from this buddy about AAT?

Dude my MA said Restaurant manager applicants are in risk, immi is refusing the cases as soon as they see manager, got no idea why they are being so strict on retail manager. Have you seen anyone winning a case AAT?

They created a group AAT somewhere with whatsapp inĀ December but i'm not sure where. I heard that too, managers are being refused.

What qualification do you use for your file?

wow, everything else seems fine he can't find any reasons so he just assumed so and refused the visa. Just wow
