457 visa turmoil

We’ve had a week of turmoil from 18/4/17. I have been going through the process of a job interview over the last 4 weeks and was offered the position on the 18/4/17 and then found out 10 minutes later about the abolition of the 457 visa.
The company that has offered me the job have been trying to find an Australian employee for nearly 12 months with no joy, they manufacture parts for the Joint Strike force (JSF) program, which is a Government contract.

I am 47 and as you can imagine before the announcement it was our last opportunity to be able to emigrate with the possibility to get PR but as my occupation is on the STOL list this only allows me to get a 2-year visa…
My partner has family (father and brother) who are Australian citizens and have been living there for 40+ years.

So now I’m at a crossroads in life and feel that the job I fought so passionately to win may have to be given up…what are the possibilities of getting PR if any at all.

Any information on available options would be much appreciated.

Hi there, 

I feel for your situation, what a nightmare.  You mentioned your partner has an Australian father? Is your partner an Australian citizen as well? If not it may be worth looking into if they can become one, surely they can given their father is Australian? At least that way your partner could maybe sponsor you for a partner visa whilst you are here on the 2+2 year visa of which your job is on the list for?

If you are willing to accept that you will have to return to the UK after four years then fine. If not, then I wouldn't. At your age (the same as mine) I wouldn't. Moving back and forth around the world is stupidly expensive - we have just moved back from Oz and the hit on finances going either way when staring towards retirement is big   

Though I am surprised they are even considering sponsorship as I would imagine it requires security clearance and that is usually not even available to permanent residents.

Unfortunately my partner isn't Australian and she returned to the UK when she was 17 and stupidly or not didn't realise that she would need a PR return visa...

As for security clearance this is not required and all PR and citizen positions are guaranteed by the Government.

Oh thats really a tough one.

If I were you I would contact a migrant lawyer to discuss your options, maybe speak to the company ask them if they have a migrant lawyer they already use to help with their previous 457 employees and discuss directly with them.

if its your dream to live there don't give up just yet. Who knows what else can change in 4 years time. Perhaps you could pivot in the job to another role which is on the medium skill list or the rules around this no PR at the end of the short term list may change, who knows. I agree with verystormy, if you do go you just have to be prepared that you will have to leave once the time is up if you have no other options by then to remain.

We're in the same boat. My hubby is 43 and we have a job offer and were ready to go ahead. Infact we had 3 job offers of people who wanted to sponsor us. Things were finally starting to go right. Dont give up yet. Look at how fast this changed..maybe we'll find another way.

As for security clearance this is not required and all PR and citizen positions are guaranteed by the Government.

I'd be surprised about the security clearance as for most government jobs, you need to be a citizen.  I'm a civil servant in the UK and cannot transfer into my opposite role in Australia due to me only being a PR and not a citizen.  So it's not a blanket rule for all jobs that the government guarantee PRs as well as citizens.  Am only putting this up just in case anyone else reads this post and takes it as gospel, so to speak.

If they've been trying to find an employee for that long, and definitely want you, can they not offer you permanent sponsorship?  Might be worth talking to them about the possibility.

Can people still apply for subclass 457 visas?

Yes. The subclass 457 program remains open until the new TSS visa comes into effect in March 2018. The occupation list has been restricted (19 April 2017) and integrity settings will be further tightened.

The risk is that the Centres of Excellence will not decide sponsorships/nominations before time runs out.
