I have applied AAT for visa refusal Thursday. Still expiry date hasn't been changed. Expiry date showing 8th March. Exactly 28 days after refusal date.

Mine changed before, maybe about 10 days after lodging the VISA AAT review, the expiry date was removed. I would go to an immigration office a few days before exp if it doesnt change

187 nomination refusal 15/11/2016 (after 9 months wait)

AAT nomintaiton appeal 29/11/2016 until now

Positon Retail Manger

Location VIC

I withdraw my visa application, and i am currently under PSW485 visa

New 187 nomination and visa lodged 3/2017

Same company and position, because My MA and Empolyrer both believe it should be approved 

Turnover 1.3M-1.5M

5-7 full time employee 

I am currently working full time since 02/2017

It has been changed after getting AAT acknowledgement letter.

I got letter from Medicare saying that i am not eligible for Medicare facilities anymore as they got adviced from IMMI. Since i applied for appeal to AAT and still I have bridging visa in effect so I should still get Medicare facilities. Any one has same situation please advice.

Hi it happened with us as well then we went to Medicare office and they send us new cards

My nomination has Been refused so my visa for Rsms

my employer does not want to appeal

i am going to appeal to AAT for my visa refusal only

could you please tell me how long should I get time for hearing only Vida appeal ? (Not nomination)

Unless you have a positive nomination result you cannot get a visa.  I don’t see the point of disputing your visa application unless you have a nomination in place, so if your potential sponsor is not disputing the nomination your visa application will automatically fail.

I agree with your comments - Its strange that the sponsor is not appealing.

If your goal is only to buy some time you can do it. That will give you some time (several months) but if AAT says that your application is not valid I am afraid you are going to be screwed!

Oh I see....when do you think that AAT will respond that my application is not valid? Is it at the time of lodgement

After a couple of days they will write to you saying that they received an application and asking to attach supporting documents. To be honest I would not know exactly when they will say if it is invalid or not (not a migration agent). You should probably contact a migration agent to see what you can do to buy time.

My Ma confirmed that AAT will accept my appeal .... But I am not very convinced about this current situation ...it is not so easy to leave the country within 28 day ..when I have been living here for 8 years with my family...it is very hard..so please let me know your opinion...I will have to act accordingly

Plz try to convince ur employer. I regret  to inform u that AAT appeal for visa been rejected in 10 days because there was no appeal for nomination for a guy I met last month. So talk to a good lawer or else try to convince ur employers that u r going to buy sometimes for nomination appeal as anytime it can be withdrawn.

You have to pay not a small amount to appeal to the AAT, and if your nomination is refused i don't think the visa refusal can be accepted, they can deny it as quick as 7 days because the nomination is not in line. To me it's such a waste of time and money, i suggest you to consult with a migration agent

Hi guys 

I have applied RCB, NOMINATION AND 187 VISA APPLICATION lodged on 1 June 2017 

under the category of marketing specialist in Canberra 

RCB APPROVED 5/8/2017

Nomination approved 10/8/2017

but unfortunately I have received refusal of my visa on 8 feb 2018 

reason is that on this category they need 5 years experience or bechlor degree. I have claimed 3 years 8 months. I don’t have bechlors degree.we going to apply AAT soon.

Please any one have any idea or have experience that after approval of nomination it was refused any what would be the possibility in AAT.

Hi all, 

I am desperately searching for the information about my visa... 

I am located in Perth, WA. 

My migration agent lodged my RSMS nomination and visa application as a financial broker nec in Feb 2017. RCB was approved before RSMS application. 

However, nomination was refused in June 2017 and the migration agent advised me to apply for the AAT so we did. 

But she did not do anything about my visa application. 

I found out late that my visa application was refused and she did not lodge AAT for my visa application. She only lodged AAT for the refused nomination. 

Now, Perth has been removed from the locations for RSMS since March 2017 and my visa application was definitely refused (did not lodged for AAT). Just in case the nomination was approved after the hearing from AAT, can I still lodge my visa application? 

 

Hopefully someone can advise me on this matter... thank you very much in advance.

The ANZSCO description for Marketing specialist 225113 and the unit code is very cut and dried unfortunately. I'm not sure what grounds you could appeal with. 

"Most occupations in this unit group have a level of skill commensurate with a bachelor degree or higher qualification. At least five years of relevant experience may substitute for the formal qualification. In some instances relevant experience and/or on-the-job training may be required in addition to the formal qualification (ANZSCO Skill Level 1)."

Thanks barker I am still working with the same employer which I started since 2013 June so in June 2018 my experience will be 5 years but is this really strange that they approved nomination but refuse visa
