- I'd assume if you are on a payroll, receiving an income you'd be considered a tax resident and have to pay / claim tax. However, if you're not getting paid or are not in a fulltime role then I'm not sure how it is that you're applying for a PR, unless it's via a DE stream? 

Sorry I wasn't clear. I was on a 457 visa living and working in Australia, applied for TRT, then got on a bridging visa and left the country for what was meant to be a short break but got locked out because of Covid.

@bluejazz thanks for the clarification - does that mean you're still employed and getting paid from the same company? 

- If yes: You are still a tax resident and would have to follow the standard tax procedures

- If no:  Then the tax would be my last concern as your PR application no longer be valid / have any chance of getting approved. Regarding Tax, you'd likely still have to submit for the time that you were getting paid / paying taxes.

@restaurant.manager I'm afraid I have no comments on this - I have no idea on the internal immigration process and when / if ever they plan to focus on hospitality occupations.

Hello everyone,

I have been a silent reader and responses here have helped me a lot in understanding the immigration process.

I just wanted to share my experience regarding my application for 186 DE visa and recent dealings with DHA over the phone.

I had applied for the visa and nomination on 18th June 2020 through a registered MA and had been quitely waiting for an update from the immigration since then.

However, I had to contact the immigration department in February, which was after the end of the estimated processing time to seek assistance if there was a way I could escalate or fast track the outcome of my visa application.  

This was because I had to urgently visit back home to see my grandmother who was in critical condition and was on her death bed. I called immigration and tried explaning them my situation as my family needed me back home in this difficult time. 

Immigration contact person simply responded by saying "We cannot help you as 90% of the applications get processed within estimated timeframe. You may belong to the remaining 10% category". Based on the previous posts here, I was aware I could not go home without the visa grant as it may not be processed at all if I travel offshore on bridging visa and my whole career depended on this.

Ultimately, a few days later I was told that my grandmother had passed away with her last wish to see me not fulfilled. I am not even sure if her soul has found peace or not. 

Such ambiguous and uncertain visa process has not only stressed me out but given me mental and emotional scars which may stay with for a long time if not for the rest of my life. 

I am not aware of your stories and I cannot imagine what you all may be going through, but I wanted to wish you all the strength and I hope things get better for everyone in similar situations soon.

Thanks so much! Yes, I am still employed and getting paid. Just wasn't sure if I should request to switch my payroll over but it makes sense that I need to remain employed by them on the same Australian payroll despite me not being there.

Your sponsor must advise what action was taken during shutdown, please ensure the following is covered.

Were any staff let go or made redundant due to COVID-19?
Is the nominee still employed full time in the nominated position?
Is the position still open and available to the nominee?
What measures were put in place for staff during shutdown?
Was there a period of stand-down/reduced hours, if so, What were they?
