Wow, what a ride closing to this Christmas.

We might be in for big news. We have been asked for updated medicals and police checks (the previous ones where dated 23/11 and expired from just a few weeks).

On the health examination list though all exams are listed as completed, and the document states:

"If a health examination is listed as 'Completed' this means that there is an existing examination that can be re-used for this visa application. You will not be asked to complete this examination again unless a repeat examination is required because your medical circumstances have changed or the examination has since expired."

Have any one of you experienced the same?

Are we in for another round of medicals or can we simply provide our most recent HAP IDs through email?

Thanks!

I imagine you have to inform them if your marital status changed though - this would have an impact on your application? Will they be included on your application or not for example?

No shes Australian and my visa is through work and not through her. I will double check if there is a section for marital status, i couldn't see one?

Well if nomination has been approved and they check that the business needs a person and their history is clear  i think there is no issue with that as have 7 friends who visa granted after nomination approved and business sold and one of them got his nomination approved even the business was sold and he is also waiting for his visa.

This is what my MA warned me about. Groups scamming or lying. THIS is the reason for my 18 month wait, massive scrutiny of my role, and endless stress. Not only for me but for many here. I'm honestly disgusted. 😡

Find the Form 1022, there is a section where it does ask for maritial status.. And further on the form it will ask you what has changed. Hope it helps!!💗

Hi Lion,

This just happened to us- if you need to complete a new medical it will show on your immi account under health assessments.

Go to your account and see what it says under this section.

Also the medical examination would have been requested at the same time as a new police cert- if your request for information didn’t ask for this then you won’t need to submit it.

Hope that helps

Well, on top of the previous doubt, my application is listed as finalised from mid 2016 (date of original refusal, there has been a successful appeal in the meantime) and the interface is still locked for me.

Know that the visa is officially processing, with same TRN and all and the communications and last update date is actual, but the interface is limited (can't attach anything etc).

Did you had "(complete)" listed besides your exams in your most recent medicals requests?

I know that yours were expired too from a matter of days, so this might apply.

Anyway me and wife cheers for you too Bella (and for pretty much all this forum); once all this visa storm is behind we should organize a meet up of sort for this forum thread.

In the meantime I'll smile upon you all, with my full 37+ months of wait 🙂

I think you and your 7 friends playing the system like this is what results in further scrutiny and really brutal decisions made by Case Officers under the tremendous building pressure of the media.

Thus resulting in genuine applications for people who genuinely need these people to work getting refused for the tiniest smallest pathetic reasons whilst you and your mates well....

That aside - i'm absolutely flabbergasted you would openly say this on this forum.

Let's hope immigration don't monitor forums like these - for your sake!

Good on you for replying.  I reckon you were biting your tongue and re-wrote the post a few times before clicking submit.

I cannot fathom why a percentage of people are attempting to abuse the system which causes unneeded stress for genuine applicants and causes delays in processing times.

It is extremely selfish.

@BB88 Friendly heads up - there is now a "congratulations" emoticon ( 🎉 ) icon (if you hover over the heart icon). It was added to help try avoid reposts purely for "congratulations".

Regardless, it's there in case you didn't know about it - use it / don't use it 🙂

Thanks for the reply guys. So we knew the new benchmark got tougher than before, so we paid extra attention to it. But CO was just super picky on this, so the reasons were;

1. There were couple of invoices that a trainer came to the company and gave us training about teaching (we are a very small school), and CO said there is no written evidence that those training were given to actual 'PR' holder staff or citizen staff on the invoice. Like, who writes that some product is for PR or citizen holder on the invoice? AND we could more than be happy to provide extra documents if CO asked.

2. Training benchmarks were paid on time. But CO said there is no evidence that it was actually paid from the company's account. We provided our MA bank statements of specific period of training benchmarks were paid, but our MA didn't submit it, but again, if CO asked it, we could have sent those evidences right away.

Well it is too late for me, but they really do refuse nominations without asking further documents, so keep that in mind folks.

HI CCP,

So sorry to hear about your situation. My reply might be too late now as I just found your post today. However I just wanna share my case.

My case is exactly the same as you. I got my nomination refused in June2018(Ens186 Pastrycook transits from 457). The reasons of refusal was that there was insufficient evidence (receipts, a written report of the training outcome) to show that PR or Citizen were giving training. After having consultations from 2 migration agents and 2 migration lawyers, then I decided to reapply as those migration specialists said there is the best option for me so far. The positive point for reapply option is that  the laws have chance. So.if you lodge a nomination application after 12 August 2018 the case officer are now not required to assess the training benchmark requirements as all businesses that nominate permanent or temporary staff must simply pay the training contribution charge( $3,000 for business with a turnover  less than 10 million.

Anyway my case still has risks as the refusal decision of the previous nomination is on record and it could be adverse information and this can affect to the new nomination so the best way to do is providing  a strong submission about the previous training issue. Or if I'm lucky , the case officer might not give  weight to the training benchmark issue on the record as it has been discarded by the new laws. Finger cross and always have a good hope!

What I want to tell you is that don't just stick on one migration agent but seek a lot of second opinions from several agents or even lawyers to ensure you get the best solution. Good luck!

I reapply  my new application because old nomination refuse june 2018 reason genuine position. New application lodge Aug. Reapply is better option rather than go to appeal.

According to current processing timelines and with other visa grants we should hopefully hear back after the new year...unless we are one of the unlucky ones 😢

You said before the average wait time was around 10 months - I'm now hoping with a further decline of 2 months on the Processing Times, we'll be looking at 8 🙂 Fingers crossed.

A lot of CO staff free'd up with the 457 Applications pretty much finalized.

Hi Lion,

wow that sounds complicated.

Mine did have complete next to them yes - if you are required to do so it will say so in your further request for information. Mine were actually out by 10 months so i wasn't too surprised to be requested to do again.

I'm cheering for you too.

I like your name- i'm a leo star sign so i generally like lions! ahha!
