This info comes directly from the department of immigration and given it's in an email - I would think it is pretty accurate :) 

Thanks for your encouragements - I had your state of mind before - especially when I was early in the process and thought my file would be picked up quickly because it was straight forward, complete and sponsored by a prestigious company. It all changed when I got stuck too and now I understand how it feels. It's really not a good space to be in. And with all due respect, it does not help to be told to be patient because clearly we all have been patient already :)

I respect your assumptions and beliefs but having been here for over a year and having looked at the patterns - especially for certain occupations such as Customer Manager, Marketing Specialist, Cooks - I can assure that applications for certain occupations are definitely slower no matter how straight forward the cases are.

The main reason being that these occupations are in the top 5 of the most applied for and are not necessarily identified as "needed" in Australia.

I saw a few Marketing Specialists before me being stuck in the process. They were sponsored by huge businesses. One of them (Lizzi) had studied in Oz, and had her whole work experience in Oz as well. Definitely nothing complex about her file. Her file got approved after 13 months while she got told it would take 4 to 6 months.

Regarding the March 2017 application, that's good for the applicant. I do not think that their application was less complex than any other that is stuck since 2016 - they just got lucky or there might have been some kind of special circumstances we do not know about. I noticed that some aspect of the process does appear quite random.  I also heard that some companies seem to have better contacts than others... Not sure how true/believable that is though...

I think it is important for people who are stuck in the system to have a space to express their emotions without feeling inadequate. Here, there is a community of people that understands how it feels. At least here, people can find a comforting space. This is an extremely stressful situation to be stuck without any possible status update or communication. This is even more stressful to be stuck now because the Australian Government is constantly making quite drastic short-sighted retro-active changes. The climate is also pretty negative towards immigrants right now.

I am thankful to have supporting people around me, recently my partner PT (originally from the UK) told him that when he applied, several years ago, his file took 18 months (and I think it was transition stream). It was a pretty straight forward application but it got stuck. My gut feeling says that he got stuck because the Fitness Instructor occupation was not super needed in OZ - I actually think it's not even on any list anymore now.

Anyways, big hug for everyone who has waited so long already. I really hope the 2015/2016 files get all processed quickly so we can all go on with our lives.

Jess,  So i have been told today that i am no longer Skill exempt.  My MA has just sent me this

"At this stage your application is impacted by a law that was introduced on 1 July 2017 which now applies retrospectively to all applications under the direct entry stream relying on the skills exemption which are still pending approval"

Not sure if this impacts you or not.  I will now have to go through a skills assessment, which is not an issue but its another delay in the processing of the application.

Have you done a skills assessment as a marketing specialist?  if you did any watch outs.

Hi lovely people,

I applied for my PR (through 186) and the department asked my agent for additional documents.

I was just wondering if anyone of you was in the same position? How long did it take to get a final decision? 

My agent said it's depended on the efficiency of my CO. Some would be able to make a decision within a day, sometimes it could take months. 

Just wanted to see what your experiences were :)

Hi Guys, If someone could help me that would be great. I am currently on 457. Last year I changed my role with in the company and we forgot to update the information with Immi. Now I am applying for 186 transition on the role I am originally sponsored on. My payslip or contract doesn't show the new role that I am in. Am I still be able to apply TRS 186 or would it be risky?

Hi mate i m on a same boat as you. Immigration asked for further documents in April 28 as I applied for 186 on march 2016 . But still nothing comes up yet it's really frustrating. Sometimes it's depends on luck.

So sorry about that :( Yes I had done it indeed. I contacted my MA quickly and nothing needs to be added to my file from the recent changes.

That's why that whole thing is stressful - making those retro-active changes for people that have already waited so long...

hey guys just a quick question. I got an email from my migration agent today with a response from immigration stating that my application has recently been allocated to a team for assessment and a case officer will be in contact if further information is needed. my question is am I close to getting the visa approved or a while left yet? i am applying for a 186 business sponsored. Thanks for your help.

requested three quarters BAS statement (the one have to download from Business portal) on 29/May 2017, Submitted on 5/June 2017, including one extra reference letter to explain why company's turnover had huge up and down as a new company 

approval for both 06/July 2017

my detailed timeline

  • started to work under 457 around March 2014
  • applied ENS transition around March 2016
  • company change owner, new ABN, but same company name, same role, same company structure
  • canceled my application around June 2016, wasted $4000 application fee and $4000 MA fees due to this change
  • applied new nomination under new ABN, and also skill assessment (I did submit skill assessment even i was going through transition), both done around Nov 2016
  • reapply transition 9/Dec 2016
  • Got approval today!!

I was a try hard type of person and submitted a lot of documents (closing to 60 documents limitation). I learned a lot from this forum, so that I was able to be prepared for my special situation. Big thanks to all your contribution.

If anyone went through similar situation like me that company changing owner, feel free to message me for the experience. Even though I used MA for my applications, I went through all aspect of this VISA myself including company's part. 

I won't spend time to describe the hard time I had for past several years, stress and pain or whatever, we all know that desperation, but I want to wish all you guys good luck!!! Keep fighting!!!

Good news, I got my approval yesterday! 

Applied for 186 business sponsored Dec 16

Department requested additional information end of June

One week later - APPROVED 

 

I hope this gives you a bit of hope, it's the worst to be stuck in a state of waiting and uncertainty.

Hang in there, my heart goes out to you!

Hi..I am primary applicant for 186 transition visa..my wife is 8 months pregnant & we didn't go through medical yet..my question is will immi wait for medical of both applicants to finalise the application..as my wife can't go though X-Ray because of pregnancy..plz suggest

We've asked our MA (Fragomen) to check immediately when we hit the 11 month mark so he dropped them a mail 29 June to which they responded on 4 Jul with the standard reply:-

"We are currently allocating ENS/RSMS cases lodged between April and December 2016, however not all cases in this date range have been allocated. 
You may be contacted when your case is allocated or if further information is required. Please note that we will not respond to status enquiries. "

We then received a call from MA this morning on the approval - 5 days later.

This all seemed so surreal now - but time to get our butts packing and moving ;)

Hi mate congrats. I had a same situation like you when I applied 186 my wife was pregnant about 20 weeks and i gone through medical and i had X-rays done but on that time i was worried about my baby same as you but when i went there they fitted the shield to cover belly. The X-rays just for chest so don't worry about that. I have my baby and she is absolutely normal. They do care very well about X-rays. But if you not go through medical examinations then your file process  will stops until your wife give birth.then you can go through. But it takes too much time to wait until baby born. So as per my experience I would suggest just go through x-rays and medical so it won't affect your file process time.
