Hi Everyone - I thought I'd share the below. The department is still processing April 2016.
As per spreadsheet, they are processing April since mid-March for those who are interested.

Yep so basically I think they are keeping the April files just sitting there while they look into the more recent ones..... [emoji31][emoji35]

Yeah - at this pace, they will open April 2017 before they have finished April 2016...

This is by far the most unbelievably disfunctional administrative situation I have ever experienced in my life.

Yep so true coz I can clearly remember that it started from April 2016- august 2016 , where august has gone to feb 2017 but April is sitting still ...... really no idea how this makes sense at all or do is fair according to immigration

You should be able to import your application into your immi account if you have one: https://online.immi.gov.au/lusc/login

You can only view your application status and cannot view your company nomination one.

You can see your visa status through vevo but I do not think that they show application status: http://www.border.gov.au/Busi/Visa/VEVO/how-to-view-your-visa-status-and-entitlements

Seeing your status is not super helpful because there are no details and it generally simply goes from received to finalised.

Calling immi does not really help either because that's just a support line. Even if they access your account - which they do not always do, depending on who answers the phone - they can't give any feedback on the process.

By the way, are you onshore of Offshore?

It's annoying to wait, I agree. We're onshore (in NSW). 

I'm now slightly confused with the process & steps involved. Can someone please help me out?

1. Submitted our application on 12-05-2016 with all the documents (police verification, medicals etc), Status is "Received"

2. our MA advised that the next step is for the CO to reach out to us.

3. However, as it has been over 13.5 months, we reached out to the immi helpline to enquire. The immi customer service agent asked us to double-check if the nomination is completed as that's the most critical document and that we should be alright if the nomination has been completed. He also mentioned that the pile seems to be becoming smaller now so we should hear from someone within the next 2 months- might have been an estimate.He also said he can't see a 956 form informing who our agent is!!

4. Now, we reached out to our MA to double-check and the MA told us that there definitely is a 956 form attached (but how do we be sure?)and that the "nomination application is noted as ‘assessment in process’. It has not been decided.". What does this mean and where does this leave us now?! I'm not sure if this impacts our application and if the 1 year+ wait is a waste? Furthermore, I'm praying that it doesn't impact our application timeline. There are so many questions in my mind right now and my worst fear obviously is nothing went ahead due to this step not being completed, hopefully, this is not the case.

It'd be a great help if anyone could throw a bit of light on the nomination status mentioned above. Our MA has now reached out to seek an emergency update from immi, but we have no clue when we'll hear back.

Hey Sansha - You can import your application in your immi account. Once done, you will be able to see which documents have been uploaded.

2 more months for people in May 2016. I am getting seriously depressed about that news :(

Oh wait - your MA is saying something different than immi. From my experience, I would trust your MA.

If your nomination is in process it means it is open - logically it should not take too long now :) I guess your MA will update you soon.

Basically, right now, they are checking your nomination, once approved, they will check your application.

The 1 year+ is pretty standard for Marketing Specialist DE - even it is frustrating I would not worry about this.

Hi @Bellabonkers - So it turns out my MA had already provided these documents when they lodged my file last year.

So I am not sure of what they consist of exactly - my feedback would be to call immi directly and check if you need to provide anything else.

You do not  have an MA so they will surely tell you if something is missing.

Thank's so much for your response, and so promptly too. 

The thing is i would say we have also probably provided sufficient evidence that meets the criteria- at face value it really seems like a double up. We already provide so many identity documents and evidence that your company needs you i just can't see what else they could possibly want, once I've spoken to IMMI I'll let everyone know my findings.

They should definitely talk to me as they have in the past its just i often find there answers to be conflicting so prefer to get all of my info online- just these new rules have no context yet!

Would somebody be able to post the link to the spreadsheet please- I've updated it but can never find it again in order to have a sticky beak!

Hi guys 

Just an update from my call with IMMI, I lodged my visa on the 12th July 2016 customer service manager transition stream, I spoken with immigration this morning they said my visa is going to be another 3-6month wait ? The wait is so frustrating.

FYI, About the requirement of “3 years relevant work experience” in ENS 186 Direct Entry stream. 

Migration Legislation Amendment Regulation 2013 (No. 3) 

Item 2 – Paragraph 186.234(2)(b) This item amends paragraph 186.234(2)(b) of Schedule 2 to the Principal Regulations. 

This item amends paragraph 186.234(2)(b) so that it provides that the applicant has been employed in the occupation for at least 3 years on a full time basis and at the level of skill required for the occupation. Previously, that paragraph only provided that the applicant has been employed in the occupation for at least 3 years. Previously, the absence of a skill level and full time requirement can allow applicants who had worked part time for 3 years, or who did not have the previous experience to perform the duties of the occupation, such as work as an apprentice, trainee, assistant or other developmental role, to be able to meet the three year relevant work experience requirement to be granted a Subclass 186 (Employer Nomination Scheme) visa ( ̳Subclass 186 visa‘). 

The purpose of the amendment is to support the objective of the Employer Nomination Scheme visa program as being a highly skilled program for highly skilled non-citizens by ensuring that an applicant for a Subclass 186 visa not only has the qualifications for the nominated occupation, but the capabilities and experience to fill the role.

today i was reading one article and its make me nervous, can someone explained me about how new changes will make impact on already waiting for decision(186 TRT)?? 

The article say:

 

The Australian government announced sweeping changes to the 457 visa program from 19 April 2017. However, the changes will not only have a direct impact on 457 visa applicants and employers, but also on a wider range of Australian skilled visas, in particular, the 186 Employer Nomination Scheme visa, also known as the employer sponsored permanent resident visa.

Data released by the Department of Immigration and Border Protection (DIBP) shows that more than 60% of those who applied for the 186 Employer Nomination Scheme in 2015-2016 would not qualify under the new system.

In a globally competitive market, Australia competes with other nations to attact and retain the best international talent and develop innovative products and solutions. These changes risk making it more difficult for business to secure the right skills for the job on a long-term basis.

The article is mostly about the lists.

It is true that many people who got - or will still get PR - for certain occupations would not qualify under the new rules.

However, keep in mind that the new rules and new lists apply to applications lodged after a certain date. 

If you are very nervous, again, it will certainly help to get in touch with your MA.

Many of us are just applicants and do not understand the exact details of each cases.

When it comes to News articles, try to take them with a grain of salt as they are mostly written by journalists who may not be Migration Experts either.

I must admit that I am so glad I took a MA. It really helps to manage the stress.

Hi there,

I do not know how accurate this info is. Looking at the spreadsheet, there are March 2017 applications being approved (well, at least one :) ) I believe that processing times depends on "case by case" and not on factors such as salary, occupation etc. I guess they go through applications and finalize the ones that are straight forward, complete and leave as open the ones that are more complex.

Just be patient guys, better days are coming :)

So, when everyone refers to the date of application, it means the date of lodging the application/nomination correct? Because if date of application was to be the date now (after the nomination gets approved), then that would be a bit worrisome!! :D I can't stop these annoying/unwanted questions coming up in my mind haha!! I think the extended timelines + new rule changes aren't a great combination after all. x-(

Anyway, keeping positive and hoping for the best. I'd hope for it to come through in the next month, if not earlier. Hope yours does too.

The timeline if taken from the nomination date. Most people provide both nomination and application at the same time :)
