Employer not nominating for PR

Hi,

 

I Desperately need some help as me and my family are in trouble.

 

My 457 visa expires in Jan and to re apply I needed a skills assessment which will be issued shortly as the changed the laws since almost 4 years ago (anyone re applying for Project Admin Role needs a relevant qualification, I obtained a diploma in Project Management)

 

Once I get the skills assessment I can be nominated for 186 as a Project Administrator/ Manager.

If the 457 gets renewed and I get to April I will of been with my company for 2 years and can get PR through the transition stream, either way my boss is not keen on either and wants to keep me tied to the company.

 

The same thing haopened with my last sponsor, I did 2 years and they wouldn't put my forward.

 

I have a English wife and 2 young children and I have been here for over 7years, this is really stressing my family's life out, can anyone offer a suggestion or ways I do not have to rely on the company ?

 

Can I put this application in myself?

 

Any help greatly appreciated.

Loads of people get a permanent visa without involving an employer. Australia has the skilled migrant program for this. Have you ever looked into a 189, 190 or 489 visa? My concern is your occupation might not be eligible, do you know what occupation code has been used for the 457? What state do you live in?

You are going to struggle to obtain a visa independently with the occupation of Project Manger. It is not on the SOL and currently only South Australia will consider State Sponsorship for a 190 in this occupation.

 

If you or your wife have qualifications relevant to other occupations, and independent visa may be an option, otherwise you will most likely need support from an employer.

My visa details are Business Entry (Class UC) Work (Skilled) (Subclass 457) visa - Program or Project Administrator. I live in Sydney.

 

I have set up a home in Sydney and it would be mean moving which we do not have to do if possible.

 

I believe all those visa's means moving out of NSW.

The 457 is designed as a temporary visa with the assumption you leave at the end. It is not designed as a direct path to permanent residence.

 

There is is no way of forcing an employer to sponsor pr and many have policies against it for various reasons.

 

As Rual above has stated, you have very little chance of obtaining it independently under this occupation. Does your wife have an occupation?

Ok. I asked about the state on the off chance you were in South Australia and might be able to secure a sponsorship. In this case though, you are very unlikely to be successful. You are going to need an employers support, unless your wife can obtain a skilled migrant or permanent employer sponsored visa.
