sipidan
Hi Can someone please explain the difference between De facto vs Committed to a shared life together to the exclusion of all others? To me, its exactly the same or is it the same except de-facto means you are living together? Thoughts please:chatterbox:
Marisawright
You might have to explain your definition of "a shared life" a bit more. It's perfectly possible to be dating someone "to the exclusion of all others", seeing each other every day and staying over regularly, and yet not be quite ready for a "forever" relationship. I'd say that while you're both still maintaining separate households, you're not de facto - unless there's some other reason why you can't move in together, like having to work in different cities. rosiew
Back in the olden days when my husband got his visa you had to show that you lived in a 'marriage like relationship' produce all of the evidence and get people to swear that you lived in that kind of relationship. So perhaps take that as your guide. Obviously married people enmesh their finances and admin to varying degrees, but the more enmeshed, the easier it is to prove. Quinkla
According to the DIBP website, for migration purposes, a person is in a de facto relationship with another person if they: are not married to each other have a mutual commitment to a shared life to the exclusion of all others are in a genuine and continuing relationship live together or do not live separately and apart on a permanent basis are not related by family. So to be de facto, you must have a mutual commitment to a shared life to the exclusion of all others, but you would also have to meet the other requirements in the list.
