I own a very small bricklaying company in WA and am looking to sponsor a British national so that he is able to stay working with me. I am trying to gauge whether or not I need a migration agent or whether I can work through the nomination process myself. I am unsure on how I would provide evidence for the following requirements (in terms of the format etc. as I know the immigration department can be very particular): evidence that the position is currently occupied by a temporary resident evidence of an increase in business activity (e.g. new contracts won) requiring workers in the nominated occupation If anyone can offer any advice around these requirements or just employer nominations in general I would be incredibly grateful! MaggieMay24 Posted June 28, 2015 Share Posted June 28, 2015 I assume the first bullet point could be proved if you had a temporary resident already filling the position (e.g. on a working holiday visa) or a previous 457 visa holder. But in general I'd suggest you speak with a migration agent. The process can look deceptively easy in places, but it's complex and can be expensive if you get it wrong. wrussell Posted June 29, 2015 Share Posted June 29, 2015 Before you could nominate a prospective employee, you would have to be approved as a Standard Business Sponsor then you could nominate an employee and then the prospective employee could apply for a visa. It is possible to lodge all three applications at the same time, but sometimes ill advised. From what you have posted, I advise that you at least need to consult a registered migration agent to ascertain whether you and your prospective employee can satisfy the relevant criteria for the three steps.
