SGHJLL
My 19 year old daughter has a PR visa. She has lived in Vic with us for a year and also spent four weeks with us in Aus when we validated the visas. She is returning to the UK to study law at Cambridge University but her PR visa expires July 2016. Her course does not finish until July the following year. Even if she returns for every holiday to Aus she will not have accrued the full 2 years living in Aus to gain the return permit - she will be about 3 months short. She is adamant she wishes to return to live in Australia after finishing her law degree. Also there is no way in the world she should give up her place at Cambridge. Is there any other way of extending the PR visa without having lived here for the full 2 years?
Pumpkin
There is no rule that sys she does have to live in Australia for two years in order to get a RRV.
SGHJLL
It says on the immi website that you need to have spent at least 2 years within the past 5 years living in Aus to obtain the returning resident visa?
Pumpkin
It says on the immi website that you need to have spent at least 2 years within the past 5 years living in Aus to obtain the returning resident visa? No it doesn't. It does not require two years to get a RRV, it only requires two years to get a 5 year RRV. It just requires close ties to get a one year RRV and family in Australia would be her close ties. Nevertheless, I would suggest that in the university holidays before her visa expires, she comes over to visit and applies for the RRV then. if she times it well, should be just enough to get her to the end of the course and then she comes back promptly. Worse case scenario she has to apply for another one, the second RRV will be a bit harder, but she will have very good reasons and still has her close ties. VERYSTORMY
One thing to be aware of. If she is no longer normally resident in the UK, she may no longer qualify for certain aspects of student funding such as loans.
julesktm1
Hi I have heard back on the same issue re our son. Should u be living in Aus and the kids travel for schooling they will be given RRV a year at a time but you have to apply for each before expiry. Best of luck xxx
