another 457 visa question..when to leave job? ?

Recommended Posts

I am currently sponsored by my employer on a 457 visa...I have accepted another job and the new employer has applied to take over the nomination..this has not been granted yet however I dnt foresee any problems...I know if I remain with current employer then I dnt need to reapply for my 457, just transfer nomination but what if I was to leave my current employer now while waiting for immi to approve new nomination? Would that cancel my visa and therefore mean I would have to reapply for another 457 from scratch? I know about the 90 days, working notice n work restrictions but im unclear on this...I knw its a risk in case new nomination refused but could nomination still be transferred even though i would have left current employer? Hope that makes sense. I just want to leave current job as soon as :( Thanks

If you leave your employer they will notify immigration that you no longer work for them, therefore you will no longer be on a visa and wouldn't legally be able to work for another company. Wait til your visa has been transferred then give your notice an leave. Although we just transferred and took 8 weeks! X

Also is your new employer deffinatly able to sponsor you? As they have to be a nominated sponsor to be able to sponsor you, last thing you want is to leave your job and for your new employer not to be able to sponsor you

You can leave when ever you want (subject to notice period at you your current employer I imagine) you just can't work for the new employer until the nomination has been approved and you can't work for anyone else in the meantime.

Thanks for the input..I understand I can leave when I like and cant work till nomination approved..but if I left would I need to start 457 process all over again? Or would the transfer of nomination application just continue? 8weeks is a long time :(
