Guest pj Posted August 14, 2006 Share Posted August 14, 2006 Hi Sorry to be the bearer of bad news but 457 visas do not lead to PR. You have to apply in the usual manner if you want PR as I was advised by our migration consultant. There is an ENS route where your company can nominate you for PR status after 2 years of service, however, this process is expensive and reasonably complex compared with the easy 457. I was under this impression too when I arrive in Australia so started the PR process immediately as I want the freedom to work anywhere and for anyone. Good luck! Guest gazoberg Posted August 14, 2006 Share Posted August 14, 2006 im going to work in brisbane on a 457 and have been told by a variety of immigration people that it is 2.5 years before you can apply for perm res. or even dual res if you so decide. You do have to go through the process like everyone else but have been told it is easier and much quicker than doing it from the UK and as long as you havent been a naughty boy in Oz and the company you are working will give you full time employment you should be fine. The Employer Nomination Scheme (or Regional Sponsored Migration Scheme) visa's are permanent visa's. An applicant can qualify for an ENS with or without a 457 visa. If you go to Australia on a 457 then you are free to move from employer to employer (assuming you get another one to nominate you). An applicant can apply for an ENS in 3 scenarios: 1. If they have a 457 and have worked for the employer for 2 years; 2. If their remuneration package is greater than $151,500 and they are deemed highly skilled; 3. If they are deemed highly skilled for which they need a skills assessment by a relevant assessing body. RT Hi RT When the meds are "referred" it means they have been sent the nmeds-file to the Medical Officer of the Commonwealth for an opinion about whether or not the health-criteria for migration are met. In your own case, it is likely that your Hubby's meds have been deferred because of his having had Non Hodgkins Lymphoma. Did you give the Panel Doctor all the specialists' reports about that and were any of them fairly recent? The MOC sometimes asks for more up-to-date consultants' reports, and/or more tests if there are any that might be useful to the MOC without harming the patient/applicant. It does NOT mean that the application will fail. My elderly Mum is disabled due to a back-injury a few years ago. The MOC packed her off to a geriatrician to discover whether or not she is a candidate for residential care. The geriatrician confirmed that she does not require residential care and nothing to suggest that she might do so in the future. She is now in the final stages of obtaining her visa. I've heard of and from LOADS of other people who have had to see consultants/have special tests done, but they have been OK via-a-vis the MOC in the end, so don't panic. Phil would be able to explain whether or not, with a 457 visa, there would be a possibility of an appeal to the MRT in the event of the MOC refusing your hubby. Some visas can be appealed to the MRT, others can't and I'm not sure which way it is for a 457 visa. However, I remember your saying that your application is being handled by agents hired by your own prospective employers. Since they knew that your hubby has had this disease, I guess it could be that they chose a 457 visa for you because it carries the right sort of appeal-rights if push comes to shove. I suspect that the next step for you, though, is to sit tight and wait to see what, if anything, the MOC says. If anything else needs to be added, I hope that Phil will chip in with it. I think we'll just get into Oz and then take it from there - obviously depends on if we like it out there which i'm sure we will (i've never been so am diving in at the deep end)!
