Dollb Posted April 27, 2013 Posted April 27, 2013 Is there any min stay requirement for 457 primary visa applicant? actually the catch is, We are from Malaysia and opening a Business in Aus. My bf wants me to go Aus and tc of the business while he tc of Malaysian business. But because he has enough experience and qualification to apply 457 we are planing to apply the visa him being the main applicant and me being his dependent. He will travel to and fro Aus and M'sia... Just wonder if that would be any problem? The thing is he actually wont be in Aus for longer and i will be the one working full time all year round. Second query is- if its possible to apply 186 visa (i.e. after 2+ yrs) being me the secondary 457 visa holder as main applicant of 186 visa? By then i will already have enough experience. pls help.

Rupert Posted April 27, 2013 Posted April 27, 2013 Yes I think too complex for the forum. Self sponsor is rare and few will have experience of it. Other complications, your OH cannot sponsor himself and then not come and work here. Also no, you cannot be a dependent on the 457 and then go for a transition stream 186.

Second thought if the 457 visa is granted the main applicant will reallocate to Aus but he needs time to settle things back in home county for which he might have to travel very often. Thats why wondering if there is any min stay requirement holding 457 visa to apply 186. Any idea?

I think you are barking up the tree with this idea The primary 457 visa holder has to work full time in Australia. Your question "wondering if any min stay requirement holding 457 visa to apply 186" does not make any sense? Can you re-word it.
blossom Posted April 28, 2013 Posted April 28, 2013 Agreed, if he is not working full time (minimum 38 hours a week I believe, with four weeks holiday a year) then he is not eligible for the 457 visa. You REALLY need a mara agent for help with this one.
