Facts: We have a 2-year 457 visa. our 457 Visa expires on 7 Oct 2013. 7 Oct 2013 we will reach the 2 year work experience with the same employer, meaning we can apply for permanent residency (ENS 186). We are not sure whether we need to apply on, after or before the expiry of the 457 visa. We need 2 year work experience with the same employer, this means we can only apply on 7 Oct, same day the visa expires... we are a bit confused Due to the fact that there is a hairs breathe between our two year requirement for PR and our 457 expiring can anyone tell us when would be the absolute latest we could apply? jonbclark Posted June 17, 2013 Share Posted June 17, 2013 We are just about to apply for a 186 following 457 and have been told by our agent that the 186 cannot go in until 2 years employment have been completed. Not sure where this leaves you as you would be without a visa while your 186 is processed which can be around 6 months so yes get yourself and agent and see what solution they come up with! Scroogemacduck Posted June 17, 2013 Share Posted June 17, 2013 Very interesting and worrying,think you could or should have extended the 457 Visa to keep you legal but after the 2 years with same employer they can apply for 186 for you,then you get PR visa but are not tied to employer after that other than what you have in contract of employment...you get PR and are "free" Good luck,please keep us informed of outcome.. I would agree with this, well not sure if it can be "extended" but certainly I would be looking to get a 457 for longer, be it a new one or extension.
