Can anyone help me with this, My partner has been granted Permanent Resident visa to Australia this week, but he did not inlcude me in that time, he just updated that he is in a de facto relationship, so now he needs to make his first entry before this year but in the visa conditions says" must not marry before entering Australia", we dont plan to marry but to start applying for my visa, The doubts we have is that with that condition in the visa , will I be able to apply for my visa? or he needs to enter Australia first? we would like to enter together. My partner has been granted his PR visa but never included me in his application because we never met the defacto criteria. We are now engaged and will be living together a year come March. He has to activate his visa by June. As far as I can tell you can submit your application, we are going for partner visa, I am not sure if his visa needs to be activated before you can apply, I am interested to see what other people say with regards to this. I was under the imression that once a PR visa is granted, they are a permanent resident? I would submit your application and go from there, or go with an agent who will be able to help more. I think we will be using an agent just incase there are any problems. Sorry I couldnt be more help, if I find out anything I will let you know. I had a look yesterday at DIAC, it says that your partner must be an australian citizen or Permanent resident. Well my OH is just a PR visa holder, I am sure this is not aceptable for me to apply. I am hoping that maybe I could be an add on to his visa? There are many people that cat their visa granted then have a change of circumstances, such as falling pregnant......I dont know, I think the best course of action is to talk to an agent. Mrs Fabricator Posted January 12, 2013 Share Posted January 12, 2013 I think you are a permanent resident once you enter the country for the first time, when your visa is first granted you get a year to activate as in go to Oz, you can leave again but you need to go over first, if that makes sense........I talked to 2 agents yesterday, seem that my visa application is not as straight forward, need to get loads of info together, glad I rang tho, it answered a lot of questions. Rupert Posted January 12, 2013 Share Posted January 12, 2013 I do not see how you can apply for a partner visa now, when last week when his pr visa was granted he did not declare a partner. Did the 12 months of living together literally occur in the last seven days? If not why were you not included in the first place? it is not optional to disclose a partner, it is compulsory and being untruthful in a visa application can lead to cancellation.
