Can I leave here now on 119 visa?

Dear sir or madam

 

 

I am working in WA with PR (subclass 119). I have been already in here nearly 2 years. But my visa was only graunted 07.2011. Do I need to sign another contract with the company?

Cause By looking at the immigration site of Australia government there is an obligation for the employee to remain working in the same position in the regional area at least for two years.

 

 

Recently all the full time employees got a review and pay raise but me. I am already earn less than anybody else who is doing the same job. So I feel really angry by their unfair to me. But I am scared to rise my voice cause after all they sponsored me.

 

 

And everything here is very expensive and my wife just had a baby. We cant make enough money for life. I really can't stay in here anymore. Please tell me is there any way to leave here without canceling my visa?

 

Can I leave if the employer agrees?

the two years starts from when the visa is issued. So no, you are not supposed to leave yet.

They are supposed to pay you equal to their other employees though. Have you asked why you did not get the same payrise as everyone else?

Actually the employer does not care the 4 or 5 months I stay here or not. Just afraid the DIAC will follow check or not. Then will get trouble? Thanks a lot.

It is possible that they will cancel your visa. In reality, if you have made every effort to stay in the job then they won't. You are not describing a situation where it will be acceptable to leave. They are still paying you what they agreed, and you haven't done your two years yet.
