Passports, marriage cert, birth certs etc. Also what would she actually write on the copies e.g. I certify................?? Also on the stat decs form 888 section 6 where the witness signs, does this have to be witnessed by anyone if you are in the UK and applying offshore? Guest Posted January 5, 2013 Share Posted January 5, 2013 I don't think so. A magistrate, doctor, solicitor and so on. I'd not risk it using a physio. We are having the local magistrate do our certifying. I called and checked and I have to call and book an appointment at a few days in advance. Then drop off all the things we want certified at least 2 days before so they can prepare it all, then go in a couple of days later to the court and the magistrate will do them all then. £60 for the lot. Re the stat dec's from Aus citizens, all our stat decs were/are witnessed by approved people from the list and all done in Aus and then mailed over to us. Guest Guest26110 Posted January 5, 2013 Share Posted January 5, 2013 I rang the visa department, Australia House in London, and was told as we are in the UK we could ask anyone from the UK who knew us as a couple to fill in the stat dec form. Just not sure if it needed to be witnessed by anyone. You mean you don't have any Aus family who can do a stat dec and so are using people in the UK? In that case, yes, according to the booklet they must be done on stat dec forms and must be certified properly. Page 29 of the partner migration booklet. I'd be cautious and get them done by a solicitor or magistrate tbh. The list is for Aus and states that if elsewhere it should be conform to the country's legal practices. I know in the UK there is a list of people who can but I am not sure a physio is on that list. I think it always looks better on the application if its a solicitor, magistrate or something along those lines. Plus you know they are defo going to be acceptable. At the price I am paying for the application, I go along the lines of why chance anything, if in doubt or unsure. Go the concrete route and know its done properly and there cannot be any worry then. Tulip Posted January 5, 2013 Share Posted January 5, 2013 I wouldn't use a physio, I checked a list of the people who can do it here in the UK (not hte list for Australia) and it was very short, solicitor, justice of the peace, etc. I had a solicitor do them, fiver a copy, so not too bad. He also witnessed a statement from my mum supporting the visa evidence. My husband's parents are doing our stat decs in Aus and posting them over. Guest GeorgeD Posted January 5, 2013 Share Posted January 5, 2013 Anyone can write a stat dec...the people who know you probably aren't all lawyers! The person witnessing the signature of the stat dec needs to be someone very specific. For Certifying or witnessing...you are in the UK, so ignore the big long list of occupations in Oz who can do it. There is a short and specific list of occupations who can do it in the UK. Australia House publish it on their own website. http://www.uk.embassy.gov.au/lhlh/immi_certification.html The list of people who can do it in Oz is huge (AH don't list it all, they just say, and anyone else recognised to do it)...so if any of your stat decs are written in Oz you can get a variety of people to witness them there. Same goes for any documents you want certified...if the certification is being done in Oz, then a load of people can do it. In the UK, the list is very specific: UK Solicitor Magistrate Notary Public Justice of the Peace Officer of a Court appointed by a Judge to take affidavits So, to answer your question, can a Physio certify documents? No. (Not unless they also happen to be a JP or Solicitor or similar!) People will tell you they got their Bank Manager or Accountant or Priest or Doctor, etc, etc to certify documents...and they may not have had any problems...but the list is there, it is published in black and white, it is current...why would you want to take the chance and not do it exactly the way the office processing your application says it needs to be done...stick to the list. You may need to pay for these services...shop around, it really shouldn't be expensive. If you are using a lawyer for anything else ask them to do it at the same time...selling your house, writing a will (which can be used as relationship evidence in your application), etc. Honestly, it's not worth losing any sleep over, stick to the list and you won't have any problems. They will also do it properly...I had a Scottish solicitor certify a document I sent to the Australian Tax Office when applying from overseas for a Tax File Number (I was in a very unique situation whereby they requested me to get one from overseas, long story, doesn't happen often.) The ATO returned the document as unacceptable saying the wording of the certification was wrong...I had to get him to write a legal letter to them confirming his qualifications, that he was legally qualified to certify documents according to the law of the jurisdiction in which I lived and that the wording was correct in Scotland...they then accepted it. Took an extra month because they needed original copies, returned original copies by post and needed the confirmation in writing with original signature.
