Guest Guest26110 Posted January 3, 2013 Share Posted January 3, 2013 Hi, im just about to submit the forms for me sponsoring my husband on a partner visa, Im sure he will be granted permanent residence straight away we have been married many years and have 5 children together. I understand that from date of medical he will have 1 year to activate the visa and then if we dont decide to move straight away he has 5 years to move. My question is once we move over to Oz, what are the rules of the visa. Do you have to reside in Australia for a certain amount of time i.e. until he can apply for citizenship (i think this is 4 years) or can he freely move between UK and Oz as he wishes. Just wondered what the actual visa rules are, dont want it to be withdrawn if you have to be in Oz for a certain amount of time. Thank you for any replies. Tulip Posted January 3, 2013 Share Posted January 3, 2013 Hi. You'll be requested for a medical, don't think you can front load with them. You'll be granted the subclass visa or the PR visa; if the subclass temp visa, he can move and work in Australia as he likes, but cannot claim benefits there. When granted the PR visa, he will be able to work and move in and out of Australia as he pleases and will be able to claim benefits if need be. I'm not sure about the rest to be honest. pitrat Posted January 3, 2013 Share Posted January 3, 2013 Hi, I have my sub class 100 visa and have to activate before April 2013, then I only have to live in Australia for 2 years then am entitled to apply for citizenship and passport. We have decided that Australia is not for us at the moment as we both have very good jobs in UK at the moment and almost paid our house off, so the jump to lesser paid jobs and massive house prices doesn't appeal at the moment! If we want sun we just book a holiday to Mexico or Greece, think this option to get away would disapear as flying anywhere outside Australia costs a fortune. Hope this helps. It used to be two years before you (general you) could apply for citizenship but it is now 4 and has been since 2007. OP - as above husband needs to spend four years in Australia to qualifiy for citizenship, there are allowed periods out of the country, however if he were say spending 6 months in and 6 months out, then he is not going to meet the criteria and would need to get the rrv at the end of the initial five year visa. As Rupert has said, this is wrong...you need to have been a Resident of Australia for at least 4 years to become a Citizen. If pitrat has been a temp resident for 2 years before becoming a PR then it's fine, but just 2 years on PR with nothing before it doesn't make you eligible. The Citizenship website is actually one of the more easily understood areas of the DIAC world...http://www.citizenship.gov.au/ Have a look through the eligibility and Resience Calculator bits. I know people who have been PRs for 40+ years. They come and go on the RRV...so you don't need to become a Citizen if you don't want to or can't meet the eligibility. Just be careful...if he goes back to the Uk for 5 years, he might not be eligible for the RRV and won't get back in...this can happen.
