Larry65
Hi. We have a rental in and it says on the lease that we have to give 3 weeks' notice if we want to vacate. The problem is the agency started asking if we want to renew 2-3 months before the lease runs out and has now become quite insistent we let them know one way or the other even though the current lease runs for another 7 weeks. I don't want to risk them withdrawing the offer (especially with a small toddler) but we haven't found another rental we like. We want to keep looking for somewhere else but we now feel forced to renew immediately in case they withdraw the offer. Can I ask other renters here, how much notice do you have to give your agency that you want to renew or leave?
Rupert
Tenancy laws vary by state and you don't say where you are. Here in NSW we had similar situation, being chased to renew when we had a couple of months left. They wanted to get us onto an other lease as if it goes past the end of the lease expiry date it is just rolling one months notice from then on. We decided to sign as we like it here and it gives us the security as well as landlord. What do you want to do, move or stay? You need to give whatever notice is in your agreement I guess, if you don't want to be pressured into something then just tell them you haven't decided. Or just keep telling them yes you will be in to sign up shortly and then dont go..
Larry65
Sorry Rupert, I should have said. I live in SA. The place we are at is ok but I think we could find something better so I am looking. If I put them off and say I haven't decided yet, could they withdraw the offer? Petals
If you are good tenants they will want you to stay. I would just ignore it keep staying and keep paying till I wanted to move. Check with SA consumer affairs they usually have all the information on the site to help you with rentals.
blossom
Yer, I would probably say yes, the contract will be in the post closer to the time and then just give notice if you do find something else.
Larry65
Thank you so much for your replies. I really appreciate it. I have emailed the agent to say we will return the signed lease form soon. I'll keep looking in the meantime. Does this happen with all agents do you think? Addy
We are in SA and our rental agent has always asked us to renew the lease 3 months before it was due. Not sure if it is common practice or just our agent. you could always ask for a shorter lease if you want to keep looking.
keily
we are in wa ...and our past rentals always asked us to sign 2 months before ...standard practice i think to give them time to readvertise if u dont want it ...you could always ask to go onto a perodical rental which means you wouldnt be tied in for another 6 months ...however the down side of this is they could ask you to leave before your ready to go .....best thing is to be honest with agent tell them your circumstances and see what they advise mrs keily
