What type of visa do you have? If 190, you have to work and live in WA for two years; if 189, you can work and live anywhere in Australia. There is no visa condition that states you must work in your nominated state, it is a moral obligation. There are many threads discussing this moral obligation in depth. It will have no affect on citizenship. Have you read the citizenship act 2007. It even states on the skill select page under 190 you can live and work anywhere in Australia. It also states on the same skillselect page under the "visa holder" tab that 190 visa holders must " fulfil employment obligations.......that states or territories will require you to meet". At the bottom of the same tab in bold it also states you must "comply with visa conditions and Australian laws". Bit confusing don't you think? I feel that you should give WA first preference and try your level best to seek suitable employment there. I'm in a very similar situation since I hold a SC 176 visa( WA sponsored), and I did receive some real good job offers from Melbourne too. Also, since I have family in Melbourne, moving there would have possibly been the best thing ever for me. However, I knew that I have a 2 year commitment towards WA, since it's because of their sponsorship that I've been granted a PR visa, and so I arrived in Perth and managed to find a job within 2 weeks. Although the job isn't that great and it doesn't really do justice to my previous experience, I'm glad I was able to fulfill my "moral obligation". And to be honest, 2 years isn't really that long. Having said that, if you're still unable to find yourself a job in WA, have a chat with the State Migration folks and let them know of your situation. I'm sure they wouldn't really have any problems with you moving inter-state as long as you can prove that you've tried hard enough! Good luck ! Guest spreadingwings Posted January 1, 2013 Share Posted January 1, 2013 Re the moral obligation on the 190 visa, a well-respected migration agent has advised that this is a state requirement and not a DIAC requirement, and will therefore not affect your visa, PR or citizenship in any way. This makes sense if you think about it, as circumstances change over time. If you receive state sponsorship today but only move in 4 years (you have a max of 5 years to move) and can no longer find a job in the state that sponsored you, Australia as a country (DIAC) still wants you in the country as they approved your visa, not the state. My partner should be able to get a job however my area of work doesn't seem to have as many oppurtnities or same rates of pay as at home where as there are more oppurtunities in Sydney and Melbourne where we also have family.
