Guest The Birmingham Villains Posted January 16, 2008 Posted January 16, 2008 Hi all, we are going to Brisbane for a recce in March. There will be myself, wife and three children. When I say children, ages 11, 14,and 18. Does anyone know if my eldest would be able to come on a 457 visa if I am successful with an interview or would he have to have a separate visa application seeing as though he is not a dependant at 18? Guest billy braveheart Posted January 17, 2008 Posted January 17, 2008 dont know about getting here but when hes here he must be seen as a dependant therefore cant work full time they are only allowed to work 20 hours per week so as to be seen as dependant so able to gain pr hope that helps a bit billy

Braveheart/ CalNGary, My eldest deferred a year at uni as we thought we might have been there by now but with different circumstances it was not to be and we did not think it fair if he took his place and then dropped out therefore taking the place of someone else who could do the full term at uni. At this moment he is working and has not got a student card therefore is not dependant but living at home with us. I am afraid he is enjoying working and earning and may not want to go back to uni in England or Oz. For him to come on our 457 visa (fingers crossed) would you advise for him to apply to uni in Brisbane. How else could we claim that he is dependant. Much appreciated Kev
Guest Gollywobbler Posted January 17, 2008 Posted January 17, 2008 Hi Kev I think you should speak with a Migration Agent sooner rather than later because I have a feeling that the "chai of dependence" (for wat of abetter expression) may be broken if your son is working full-time, regardlessof whether or not he still lives at home. Under 18 they are automatically classed as dependent. Between the agesof 18 & 25 I think they must be in full-time education to count as remaining dependent on you. The criteria for this work in the same way as for a Child Visa, so please see the following links: Child Visa (Offshore) (Subclass 101) Child Migration Booklet But I think you should get expert advice quickly because I don't know whether you can reverse the position by sending your son to Uni/college either now or once you move to Brisbane.
