Guest bassam Posted August 28, 2012 Share Posted August 28, 2012 G'day Everyone, I am planning to get married in December, I am an Australian Resident. My fiancee is from Canada. So instead of applying for her spouse visa off-shore, I am planning to apply her working holiday visa now and bring her in Australia on that and apply on-shore spouse visa later on. Guest GeorgeD Posted August 28, 2012 Share Posted August 28, 2012 As long as he WHV is granted with a No Further Stay condition then it will work. You aren't supposed to enter Oz on a WHV with the intention to apply for a different visa, but the reality is many people do it, and it does work. Once she applies for the Spouse visa onshore she will be eligible for a bridging visa when her WHV runs out to allow her to remain legally until the decision on her Spouse Visa is processed. If you mean the Spouse Visa then you should meet the requirements for Defacto Spouse, or be married to waive the defacto requierments. If you are getting married soon, I would probably say go for WHV, enter Oz, then get married, then apply Onshore for the Spouse visa as a married couple.
