Help Please

Hi All

 

I have been reading a lot on this forum over the past several weeks and want to thank you for such an informative site.

 

I was hoping you could help me. My partner and I have been in communication for 5 and a half years (we met on the internet). I went over to meet him in the uk after a year talking for 1 month. He then come to see me for 1 month and has been out a further three times at three months each time. We talk everyday. I will be his sponsor and I have a good paying job with the government that I have held for many years. My partner has not been employed for a lot of years. We fell short on the being together for a year physically part but the information we have supplied shows an ongoing relationship and we have supplied 7 stat dec's from my work colleagues and family, phone bills, over 20 western union receipts as we have no joint accounts.

 

My partner and I sent in our visa application (309/100) on the 28th June and received a CO on the 5th July 2012. We had further information requested on 6th July in relation to financial statements and statutory declaration, we returned all of this information by the 12th July asking if anything at all further was required as I still had one stat dec to pick up from my brother.. An email was sent back saying that now she had all the information she would start looking at the application. Then on the 21st July we received an email just to confirm that she had received everything. We again wrote back saying that she had received everything but that we could provide anything else required. At this time we also asked what the estimated processing time was as my partner was going to come out to Australia if the time was going to be lengthy. We received an email back yesterday saying the she would have a decision back to us by the end of the week. We are now really stressed as my partner has not been asked to go for a medical or anything. Does this sound like we are going to be declined?

Partner visas take about 5-7 months to be granted. Once all the docmentation has been looked over - your partner will be asked for Medicals and Police checks for all countries he has spend over 12 months in over last 10 years. You may need to add up the time he has spent in Australia - as if it comes to 12 months, he will need an AFP check.

We have just found out that as we suspected my partners application was refused because he did not satisfy sub regulation 309.211. My partner and I are engaged and have planned to marry in the future with no set date so we went for the 309 visa, we are now wondering if we applied for the wrong visa and should have went for the prospective marriage 300 visa. We are so confused as to how, when we live in different countries, we can show that we have joint finances and living expenses, when clearly we could not. We are so gutted and really don't know where to go from here. Any advice is so welcome....

Maybe you should get some advice from a registered Migration Agent - another Forum Guide George D, applied successfully for Partner visa when they lived apart.

 

PMV may have been the eaiser one to get due to living apart.

 

Maybe you can add other evidence - Wills, joint travel itinerys??
