Advice on parental responsabilities

Hi

 

me my partner and three children are planning on moving to OZ i have children from a previous relationship but have no contact with there biological dad they have not seen him in at least 4 years i have no idea where he lives and no contact details. i have been old that i need to find him and get him to sign a form giving me permission but i don't honestly know where to begin.

 

both my kids were born before 2003 so there biological dad does not get parental responsibilities.

 

has any one else experienced this and if so what did they have to do i know i cant be the only one.

 

it just seems like this could be a never ending battle at the minute

 

any advice would be greatly appreciated

Firstly has he got any family that you could contact to discover his whereabouts, there surly must be someone who could help. I don't know the law but if he has had no contact at all for all this time and i am assuming he pays no maintenance then i would hazard a guess that he could not care less where the children go as he clearly does not care less at the moment but i suppose he should know if you decide to move to oz, anyway good luck.

I think you need legal advice on this. Not having PR is different to having it in the UK. Not sure that there is the same differentiation under Australian law. A good Mirgration agent should be able to help. There are a few, and someone on the forum will know better than I who is best placed to point you to?? :biggrin:

I was in the same boat as you except that my ex partners whereabouts was too close for comfort. Despite him having never been given PR under the law where we live he still had to sign a certified statutory declaration and form 1229. A certified copy of ID was also required. It doesn't seem to matter that they have no responsibility in the country of the childrens birth they are just covering their backs by making sure that there will be no custody battles across continents. I would suggest you try to locate him and get him to sign the paperwork or the case officer may reject your application.

I have just been in a similar position. My daughter was in born in 2001, her biological father is on her birth certificate but he does not have PR as we were not married and the date she was born was pre change of law. We were asked by our CO to provide a statutory declaration to say he did not have PR, that we were not married and that no PR applications had been made to the courts. Once this was received we were granted our visas the following day. We used a notary of public and it cost us £60. Hope this helps :)

I was sent it by my case officer but you can also down load it from the immigration site go to immi.gov.au and foloow the links to the forms and booklets. If you have little to nothing to do with him I would advice you get all of them signed together. Be aware that the statutory declaration must be signed in front of a magistrate or notary public as it has to be witnessed, he will require ID for that as well. The same person can certify all of your documents at the same time. I know how hard this is but believe me I am now just waiting for the visa approval and it is worth the wait and the hassle, even though you don't feel like it is at the moment.
