Glastocat Posted July 25, 2012 Share Posted July 25, 2012 I joined the Spouse Visa waiting queue yesterday and the letter I got has confused me a bit. It says something about Family Migration being capped and this can cause delays, but my son is applying for citizenship by descent and I assumed if he got his Aussie passport then he wouldn't need a visa, or be subject to any capping? As Spouse visas aren't capped either, I assumed that waiting for it was the only delay we had? Is there something else I need to be applying for here? Please help, panicking a bit here! My son will get his Australian passport by descent, this is being processed. I am applying for a Spouse Visa, also being processed. Is there anything else I need to be doing, or applying for? Or is it the case that with these passports and visas we will be good to go? Hi, you don't need to do anything else except police checks and medicals, if you haven't already. There is a wait for the spouse visas and the length of the wait depends on where you are applying from. I believe applications from the UK take about five to six months at the moment. I already have my police checks and am going for my medical soon. I just got worried that I had to apply for a Family Migration visa or something, as the letter I got was seriously confusing! He didn't need to be included if he already had Australian citizenship (my kids already had Aussie passports when I put my application in). It might be worth contacting your case officer to explain that you are also applying for your son's Australian citizenship and that you will send them the details when it has been granted. My CO asked me to confirm that we were applying for his passport by descent, and I have told her that his application went in at the same time as my Spouse Visa application, so hopefully that will be ok. His application for an Australian passport by descent is being processed at the minute, if he gets that does he need a medical? I'm confused! He's 11 if that makes any difference.
