She really wants to come out for Christmas Can she come out on a 3 month Holiday visa and then when she get her visa send her passport back to London for the stamp and then when she gets it back in Oz fly out of the country and get it stamped on the way in Know its not right but its a solution

I don't know the answer to your question because I don't know the specific rules about student visas. As a general rule (but there are exceptions) if the applicant was outside Australia when the visa was applied for, s/he normally (but not invariably) has to be outside Australia when the visa is granted. I don't know whther this rule applies to student visas though. You would need to find out and don't take chances with the procedures. DIAC have no objection to people visiting Oz whilst they wait for other visas applications to be processed. However, they do stipulate that if somebody visits Australia during the wait, they must notify the visa processing office within 14 days of arrival in Oz and they must supply contact details, including a residential address in Australia. The purpose of this is to protect the visa-applicant and to ensure that the procedures do not get a chance to go wrong. If this visa is one where your s-i-l would need to be outside Australia when the visa is granted, anywhere outside Australia would do. She could go to Bali or Auckland, for example, and five days in either should be enough. The visa label can be put into her passport in either place but the London processing centre would need to know where she is going and when, so that they can send the necessary confirmation to the DIAC office in Bali or wherever, authorising them to put the visa label in her passport. Finally, I don't know whether this is true but I read a thread the other day in which someone said that one cannot enter Australia on a student visa more than 12 weeks before the start date of the course. I've no idea whether this is so, but it would be prudent to find out for sure, I would suggest. Cheers Gill
