Guest sizzla Posted December 5, 2007 Posted December 5, 2007 hi jus one question if anyone can help, what would the chances of me applying for my visa although i have three dependants here in the uk.....had my skills assessed and passed so would be applying for the 175....was meant to be a family thing, but circumstances have changed,
ali Posted December 5, 2007 Posted December 5, 2007 Sorry to hear your circumstances have changed. As far as I understnd it, there would be nothing to stop you going alone, however your dependant children will need to have medicals even if not migrating. Ali

DIAC would insist onyour non-migrating children and your non-migratig ex-Partner having medicals, but there is nothing to stop you from migrating alone. The reason why the others would have to have medicals is because a rapprochement at some stage is not impossible. If it happens, you might want to seek a Partner/Spouse visa for your ex. The children might be included ashis/her dependants. Alternatively, even if that doesn't happen, you might want to seek a Child visa for one or more of your children. With both spouse and child visas, the medical criteria for migration can be waived (and usually are, virtually irrespective of what might be wrog with the spouse or the child.) They cannot be waived with the 175 visa and with the latter, DIAC can use the "one fails, all fail" rule with the meds. If one of the others has am edical condition which would preclude him or her from meetig th medical criteria for permanent migration, DIAC could and probably would refuse your 175 application, even though there is no intention at this stage for the person with the medical condition to migrate.
