Does anyone know if a British made will is valid for a British person now living in Australia.

Hi Everyone, I was just wondering whether I should be making an Australian or UK will. I am currently in Aus and about to apply for the defacto visa. I am from the UK, all my assets are in the UK (nothing complicated, just 2 properties which I plan to keep). I have no assets currently in Aus, my partner owns the flat. There are no kids (at the moment!). If I make a will in Aus will it still be valid in the UK? or should I wait till I next go home to make one? Very confused here, so any advice would be appreichated! Thanks H :-)

Hi It's a bit of a long shot, but wonder if anyone knows whether a will has to go through probate in NSW. Also, is there a way of finding out if someone has written a will, without asking the immediate family. Thanks HH

Hi Does anyeone know if a will written in Australia can cover what I'd like done with UK assets? We've kept a house in the UK (regretting that now!!) and have a little money in the bank to collect rent/pay bills. My wife (a Kiwi) also has an ISA that it really wasn't worth selling when we left. Don't know if it makes a difference, but I'm here on a 461 visa (5yr unrestricted, Kiwi spousal) Thanks in advance for any advice Mike

Hubby and I are going to the solicitors on Wednesday to sort our wills out because emigrating has made us think about what would happen should the worst happen. I presume that a will written in the UK will be okay in Oz and that our Australian assets (house business etc) will be dealt with in the same way as they would if we were in the UK? Or should we have really waited to get this done in Australia once we get there? Or is there anything we will need to do to the will once we arrive? Is there anything that we should include in the will that relates to our particular situation of emigrating? Is there anything in relation to the children that we should include? Having never had one before, I don't really know what's what with wills, so any advice of what you have done in similar circumstances would be great! Thank you!
