  1. Hi guys, so iv arrived on a WHV with my partner, I became sponsored as the primary visa holder 2 years ago, conflict started earlier this year with my employer and I was made redundant. I can't find any other sponsor to take my visa on so my partner is lodging a 187 visa with his employment, me as a secondary BUT... as I'm not working we are kind of struggling financially so I am wondering if I can return back to England until the187 has been granted as my partner will be staying here and can my employer cover the cost of my flights even though I was already in Australia when I became sponsored. My Immi officer states I can only claim this is he paid my flights out here from England but I can't find anything about this on all the immi sites. my 457 has not yet been officially cancelled, we haven't heard from the government but it can be anytime now and we need to lodge the new 187 asap before my partner can no longer work. Any advise would help, thanks guys

    457 visa and resignation

    I have been in australia 1 year 3 months and feel my employer wants to let me go. They said they may make me redundant as we are getting funding cuts and that he would pay me 1 weeks wages. My contract states if either party breaks the contract it is 6 weeks notice so I'm a bit confused. Nothing in my contract about redundancy though! I decided to resign as at least il get 6 weeks pay but I wanted to know- If I resign do I get my flights home paid for my wife and I? i will lose my deposit on my flat that I rent so are they obliged to pay that? thanks

    Redundant 457 - now 186 or 189 visa?

    Hi all, I've just been made redundant on my 457 (after 1 year and 2 months). My 90 days starts now! Rather than go onto a new 457, I'd like to find a new employer to nominate me for a 186 Direct Entry for Permanent Residency (as I now have 3+ years experience in my skilled occupation). My questions are: 1. Which visa is better, 186 with employer or getting the PR myself and applying for 189? 2. Do I have enough time to apply for these, given I have to leave the country in 90 days? If anyone has experience of the processing times please PLEASE reply! Thanks!
  4. Hi all New to the forum, but in need to help urgently. I have been made redundant and have until early Jan to gain new sponsorship. Its not a great time and I do not have many leads. My son was born here and my wife is due with #2 in April, I consider my son an aussie and its our home. Does anyone know of ways to extend the 3 months grace after losing sponsorship?     Husband just made redundant

    Hi We have come over here on a sponsored 457 just in july and my husband has been made redundant today! My children have just settled and are into a routine and obviously we do not want to move back to the UK without making sure we have explored all areas of staying. He has a meeting with his companies recruitment consultant in the morning to see if there is another job within the company he could take and he has some contacts in Aus, but I was wondering if we should contact anyone at immigration to let them know the situation or if there is something we can do to extend the 90 day period to find another job. Any help greatly appreciated Thanks Lisa

    Redundancy on 857 visa - Help

    Hi All, Due to change of direction of the company I work at, there is a possibility I may be made redundant. Can anyone tell me where i stand with my visa and work rights? Can I get another job in the area whether it is related to the skill I was sponsored for or not? I have been working here 1 year and 8 months, 6 of which have been under the 857 visa. We have settled here and my girlfriend is a director of a child care centre but the visa is in my name so if anything happens obviously she will lose her work rights too! If anyone has gone through this before I would be very grateful if you could share your experience. If anyone knows of a good migration agent to talk to in the brisbane/sunshine coast area it would be appreciated if you could pass on their details. Thanks in advance. Paul

    Redundancy & 457 visa

    Hi, If I was made redundant while still on the 457 visa, does the comany that I work for legally have to pay for my relocation back to the UK? They paid for my relocation out here and Im aware that if I did the whole 4 years on the visa then the company would have to pay my relocation back? But what is the posistion with redundancy? Hopefully none of this will happen but in the event of "anythings possiable" I need to know what my options are. Cheers
  8. Hi My partner has been working in oz for the last 4 years as an engineer and has been with his present employer for 18months. They agreed to sponsor him on ENS 856. I am on as his de facto. At the end of august the employer submitted the nomination and this has been approved. At the beginning of September we submitted all of the other forms etc and as his current 457 expired on September 5th he is now on a bridging visa A. However it now looks like he will be made redundant tomorrow and we are extremely worried what that means for our application. Firstly, can they withdraw the nomination if it has been approved by the DIAC? And where do we stand as we very clearly have a letter of employment offering for the next 3 years. Secondly, if they can withdraw the nomination/sponsorship, what happens as technically he is on a bridging visa, not a 457? Any help would be greatly appreciated. I can't see that the company can withdraw nomination/sponsorship only 3 weeks after they submitted the nomination application to the DIAC!! Does anyone have any experience with this?   10. Hi, I'm looking to apply for a 176 Visa ACT sponsored. I have been told I qualify and I am looking around for agents and in forums like this for advice. My main query is I have been offered voluntary redundancy and by taking it what impact, if any, would there be on my application? In terms of timing my last day in the office would be 31st October, but I would be placed on 3 months gardening leave - so i guess technically it would be 31st January. I don't have to take the package now but it would make the move to Australia possible financially and I don't know if I would be offered the redundancy package again in the future. Help! Stuart

    121 visa and REDUNDANCY

    Does anyone know the legal situation if an employer makes an employee redundant during the sponsorship period.... say in the first year, second year, third year etc. Can they? do they legally have to offer them something else within the company?

    Redundancy problem

    Any advice would be gratefully received! About 2 years ago the company I work for decided to rearrange the entire business and we were told that the site I work for would be closing. Obviously after the inital shock had subsided we (hubby and I) started looking at what I could do and at the end of last year I applied for a job in Oz, which I was offered in the March. After a lot of stress the Visa finally came through a week ago and we fly to Sydney at the end of August. The problem comes because we weren't actually put on notice until the beginning of June and my on-notice period doesn't run out until beginning of December. I put in my 'counter-notice' letter last week after receiving the Visa (as this was the job clincher) asking for them to let me go early to take up my new position, but to still be paid the redundancy. I get the feeling that they plan to string this out until I go so that they can get away without paying me any money. From the information I can glean from the internet, they are obliged to reply to my counter-notice letter in reasonable time, and that it would morally and ethically wrong for them to deny me the redundancy payment; however it is not illegal as they can say they require me to work my notice to be elligible. Does anyone else have any experience of this or have any advice. I am a member of a union but it would be really difficult to persue a claim once I have left for Australia. :confused: Thanks, Jo
  15. Dear all, yes I am projecting a little! There has been a meeting at my Hubby's work today about a couple of technicians being made redundant. They will not find out who until Friday 13 (what a date eh!). So, my question is, what happens if he is made redundant with our Visa Application? I know we will have to inform the DIAC but, what is the timeline with regard to our Visa Application being valid and still acceptable (yes I have looked but as I am stressing just a little, understatement, I can't find it)?:cry: Thanks Ley x

    ENS and redundancy

    Hi, Can anyone tell me once you have got employer sponsored permanant residencey what would happen if you were made redundant? Would you have to look for another sponsor and if you could not find one would you be deported? Also how long do you have to work for the sponsor (as a permamant resident) before you would be free to leave your job without finding another sponsor? Thanks

Hi all I am really worried now as I was made redundant on the 15/05/09.On the points test there is a section on work experience which asks,have you been in full time work in your nominated trade for at least 12 months? have you been in full time work in your nominated trade for at least 24 months of the last 4 years ? and so on. Is there a waiver for redundancies due to the global economy? I could easily be out of work for 6 months!!!!!! Are my dreams shattered? We have been trying to move to Australia for years and have worked damn hard towards it.We basically stopped living our lives to save every penny and make this dream come true. I am so stressed and am sinking into deppression,all I want to do lately is sleep and seem to have lost all my energy and will to live. Please can someone give me some hope ???? :cry:

    job redundancy

    Hi everyone i'm sorry i havent been on here for a little while, but i havent been in a good place. Lots of things have been happening and not good ones and now i have more worry hubby,s job has just ask people to take voluntary redundancy it sounds good but we don't leave England till july and the job situation is not good here. The money would be good if he found another job as we cant sell the house so we will not have much money to take with us except redundancy money. But im worried if he doesnt get a job we will have to spend the money and it wont look good if he hasnt had a job for 7 months and if he doesnt take the redundancy he will be leaving in july anyway so he would miss out on the money. Sorry im waffling through tears i dont think i can take much more. 1. Does he take money and maybe get another job or maybe not 2. Stay and leave in july :unsurexmas: Advice would be helpful Thank you :cryxmas:
