Hi, I’m hoping to relocate to Australia late next year to join my Australian partner. I have a son from a previous relationship and my ex (at the moment) is refusing to let him come with me. He’s 3. I saw a couple of old posts from people who’ve been through the Leave To Remove Court procedure and I was wondering if anyone is still around who has experience with this? I can see this end in court although we do have mediation in a couple of weeks about this subject and other divorce issues. I am working on getting my case together (and trying to feel optimistic at having it approved) as if it is going to court but would really like to talk to anyone who has some experience this thanks
Good Afternoon all Im an Australian born, currently living in England for the last 22 yrs ( came on hold met a girl & the rest is history) i have been married now twice and have 2 daughters aged 17 & 19 from my first wife, two boys aged 10 & 13 from my 2nd wife, i have full residence orders for the boys and they have lived with me since the youngest was 3 mths old.... ( mother was ill & abused the kids). I Now have a new partner i we have been together for 5 years now & currently in the process of getting her a partner visa & her two daughters aged 14 & 17. What we are planning is by May 2017 the 3 oldest kids will all be over 16 & will have all finshed gcse, so its there choice to go as they want to start collage in Australia the following year. the youngest one he will be 13 yrs old so we will need the permission of his mother to take him, this will be a straight NO, so we will have to apply to the court. What i would like to know, is it best to rock the boat now and give the courts i big detailed plan for 2/3 years down the road or wait till closer to the time? Planning well in advance will this give any weight to the application? Look forward to your replies.
Hi would greatly appreciate any advice on putting together the statement for court, for use when applying for a leave to remove a child and also the pack. I have a good idea of what is required in the pack but I am unsure of how to word background info on breakdown of relationship without sounding bitter or angry (partner became violent). I have not applied to the court yet as I would like to get the paper work in order first esp as I am due to give birth in feb. I am planning on representing myself until the last hearing to keep costs down so any advice would be great. Thanks in advance.

She is an Aussie citizen, returning home, I'm coming in on the "I'm with her visa" (OK, the 309/100 sub-class). We have been planning this since 2006! The planets are aligning and at last we have been able to tell people - what a relief.......!! Living together for 8 years, so defacto visa no problem. Business interests in UK and Oz, so job not really a problem - though I may start on a contract job first to fill the coffers more! Location not firm yet, though will start in Rockingham, WA staying with family and use it as base-camp for road-trips (and air-trips!) to find the ideal piece of land. ETA in WA? Well....target August-October, visa and 'leave to remove' permitting..... Interested in hooking up with people that know the Rockingham area (we lived there for for almost a month, but only checked out the beach!). Info needed about schools (especially Rockingham Senior High - anyone got kids doing the maritime programme?), dentists, doctors etc. Woo-hoo!! We're on our way! And the GBP/AUD rate is FINALLY creeping in the right direction!
