We are a family of 5 from the country in Ireland, and like many families in here, We are experiencing sever financial difficulties I have missed paying my mortgage this month and last month, we live off credit card from the 2nd day of the month and our financial situation will only get worse as the time goes by. Although, I am working full-time, the base salary does not stretch much more than social welfare, which is a big price to pay for not being able to spend time with my 3 children. My partner can not find full-time work where we are from either. Thankfully, I have been offered a really good job with a company I have previously worked for (in the UK) in Sydney with excellent promotional prospects back in March 2011 to start in October (which I will never get anything similar here) and the chance of a life changing for the better experience for us all. We are currently in the Visa process , however, we have hit a Major stumbling block, the Visa Agent is looking for the consent from my ex partner for my son or a court Order stating that my ex has never applied for guardanship in the past I cant get this information for 2 months the courts are off till Sept. in Ireland and I cant afford a solicitor. (I am the only legal guardian), My ex-partner who is an M.D. of a firm will not consent, even though he left me and my son a week before my sons first birthday in the U.K (he returned to Dublin) My ex is not even aware of the sickness my sons has had through the years, the most recent requiring a hospital visit with suspected meningitis, my sisters were immediately in contact by phone (from Sydney and Korea and both have very responsible jobs). My sons dad has now, instructed his solicitor to bring legal proceedings with regard the "Guardianship's" to block me from taking my son from Ireland, the court will look at the "best interests of my son", so it looks like it could ruin our chances of being able to provide for my 3 children and our future in Ireland looks very bleak, with no pension, health care and one house that we will not be able to pay for soon. I am at my wits end and I have even suggested family mediation with my ex, which he agreed to attended last week (unfortunately, as I was leaving the office to attend this meeting, I received an email from his solicitor about the legal proceedings). I am crying now as I am writing this becuse I cant figure this out on my own. How will my in my sons "best interest" effect my other 2 children and my son? How long does this process take and will I lose the job offer in the interim? having a job offer in Sydney where my sister (who is also my sons Godmother and like a second mum to him) in a company I have worked for before with benefits and excellent working conditions is not an opportunity we cant afford to miss out on. I fear I am at that point where the company pull the offer, and we lose out Big Big time! Any advice is greatly needed URGENTLY and appreciated? :sad::mad:

Looks like we might be able to go out on a 457 visa as my partner has the huge possiblity of work with someone not far from Perth. However we got to get past the task of asking the father of my son from a previous relationship for consent to take my son. We have sought legal advice & have decided to go with the option of me asking him first before using solicitors, but I have no idea how to ask him, what to say & what to do All I would appreciate is a little advice from some people who have been in the situation & had to ask & how the dealt with it............. The other thing is do we need his permission before we start the process of getting our Visa's?? I have asked Visa companies & haven't been able to get a straight forward answer :eek: would really appreciate it if someone could help

  4. I have full custody of my daughter from previous marriage and have done for 6 years now. The ex wife through extreme circumstances is not allowed to have ANY contact with my daughters and court orders reflect this. They've also been updated through the years also.. I've been offered a job in Oz which I'd be silly not to take and we all want to go.. However do I need to go to court to seek permission from the ex who's not allowed to participate in her life nor indeed never paid any money for maintenance.?? Is this order I've currently got enough..?? I really don't want to go to court as it will open the circus up again and the whole process is very stressful, especially for my daughter.
  5. Hi All Just a quick question.... I've booked a 3 week holiday to England taking my 2 youngest children with me. My Husband and eldest child are staying in Perth. Do I need to get written permission or fill in any forms from my husband, the childrens father to say he agrees that its O.K for us to leave. We havent gone on holiday before seperately so didnt really know....!! Sorry if this was a silly question :embarrassed: Thanks
  6. This is a quick email to all those accidental or reluctant landlords who are letting out their UK properties and moving to Australia. My query is whether or not you have actually told your bank/mortgage provider that you are moving to Australia and if so, are they OK with this. When I have enquired about obtaining a consent to let agreement, my bank have said that so long as I don't move to Australia there is no problem....!? I am wondering how they would know.......? When one declares themselves a tax resident in Australia is there any way my mortgage provider would be notified???? Thanks in advance....
  7. My ex husband is staying in England and myself my partner and my children are emigrating to Australia later this year. I need permissin for my two youngest boys to emigrate from their father as they are under 16. He has already said that he is happy for them to go. Is there a special form that needs signing or does he just need to write a letter and sign it in front of a solicitor to state that this is so. Trace

    Consent sworn by who???

    Am a bit confused..I have read on here that even if you have your ex husbands consent to take young children to Australia you need it to be written, signed and sworn either by a court or a solicitor..which makes sense..I have been in touch with both the court and a solicitor..the court state that I do not need permission by them unless my ex is objecting to me taking them out of the country..the solicitor stated that they would sign and swear the declaration which I have made out for a charge of £5..my confusion comes in though because I have read on this site that some people have had their own declaration signed and sworn in court and some by a solicitor for a charge of around £80..both parties I assume must be present..I do not want to go through the process of going to this solicitor only to find that this is not enough and not what is required for my visa application as the charges seem to differ quite a lot..but they have stated that this is the normal charge to have a declaration of any type sworn..can anyone help pls??     Under 18 consent form - urgent

    My OH's employer has lodged and had confirmed all there half of the 457. We have uploaded everything except this under 18 consent form which when we go to the link we just cannot download to complete it if anyone still has a downloaded copy on their pc they could send to us we would be most grateful as we have tried contacting them to send a copy since Monday and CO never mentions it when we contact them pm.     Consent from Ex

    Hi, my ex dosn't have a problem giving his consent in my 17 daughter going to Oz with us, but does anyone know what sort of letter needs to be written for solicitors? I phoned my solicitor and he just asked does it have to be in a preffered style of letter? Gillian x
  11. Hi everyone, i cant believe how addictive this site gets lol !!!!!! Myself and other half are hoping to move to Perth early nexy year, we are taking with us my two children from a previous relationship. If my ex agrees that we can take them do we just need him to give written consent or do we still need to go court? Really not sure what steps to take, hope someone can help!!:wacko: thanks lee

    Consent order

    Well we have just got back from court and the judge has granted permission for us to take my 3 children to Oz with us. When the judge said yes, i could have cried, i felt quite choked up. Hopefully this is our final hurdle and our visa will be granted very soon. Thanks for everyone who has helped and supported us Tania X:laugh:
  13. Hi all, I have only been to Australia for 4 days, and about apply for Spouse Visa 309-100. In my case, do I need to include Form 1101 Police records check - consent to obtain personal information in my application? I've already prepared Form 80, and Police Certificates from countries I've lived in for over 12 months. Thanks in advance. x
  14. Just wondered if anyone can help me please. I have a son from a previous relationship and have asked for permission from my ex to take my son to live in Australia permantly which he has agreed. However he wouldnt sign a stat dec, he said it wasnt worth the paper its written on hahaha WHAT!!! :wacko: but strangely agreed and has signed a 1229 form which I believe is the parental consent form for the above. What I would like to know is this sufficient or do I need a stat dec as well?? Any help would be greatly appreciated and also does anyone have a stat dec template for consent.

    Paternal Consent.. Help!

    Hi Guys, Has any one faced ex refusing consent to bring 16 year old to Oz? My dilema is this... Do i wait till she is 18, or do i stand up to him and bring him to court? This would mean me re-mortgaging my house to pay for it, and maybe she will be nearly 18 by the time a court decision comes through anyway? My daughter is furious that he said no, she has no contact with him for the last few months due to his behaviour (he is highly manipulative and controlling, and she is at that age where she is starting to stand up to that) His "grounds" for refusing are education.. he says that she should finish her education here in Ireland, even though he has showed no interest in how she is doing. I reassured him that her education would continue in Oz. No go. :realmad: Any help or advice would be really appreciated

    childs consent form HELP

    hi everyone again This form filling is becoming mind blowing...l dont think l have done so much paperwork... getting everything together and up comes another problem.... we are doing this all electronically... We have filled in medical forms and had to fill in a consent form as we have a child under 18.... they say we can attach it electronically,.... which is what we want to do.... now the problem arises.... do we attach it with our other documents which is what we think... the problem being it tells us we are only allowed 15 documents and hubby has used all that up or is there somewhere else we can put it...... anyone out there completed that one on a 457 visa we would appreciate some guidance....

  18. my ex is playing up he reckons i have to send him a legal letter asking for consent then hewill decide if he will "allow" us to go. anyone else in or been in this situation do letters have to be legally written i feel he is just being a pain in a**e maria
