Please help ex has taken my son

Hi if anyone can offer advice i would be grateful. My son was going to his dads today to stay over nite. His school called me to express concern over the fact he had been to his guidance teacher to confide in her that his dad has told him to pack a bag as hes not coming back because hes going to get custody of him. School called me straight away i then called his dad who assured me it was rubbish and dylan must of got the wrong end of the stick. I stupidly still allowed him to pick my son up. He then called to say we need to talk theres some problems with my son. So i met him and my son at McDonalds car park today at 4 he told me my son wants to stay with him for a while i said no way not happenin he served me with a lawyers letter told my son to get in his car which he did then locked the car i was shouting and crying he told me i better get a lawyer, he said it was only for a while or something i didnt take it all in then drove off. I called my son a hour ago and its like he has no idea of the greif hes causing, he spoke like normal and said that although he wants to stay with his dad for a bit he still loves me very very much, it broke my heart, i dont know what to do hes my baby he needs to come home. I know for a fact hes been coersed into this by his father. He didnt even see our son for our nearly 2 years hes never attended a single parents evening etc etc. I dont understand he has signed papers to allow us to take him to Australia?? If anyone has any advice we are working under scots law Many thanks:cry:
  2. My son and I have permanent residency visa`s. He will be 15 when we go to Australia to initialise both our visas. He will have to return to the UK without me because his mother says he cant move to Aus until he leaves school. What would happen if he said "Dad I dont want to go back to the UK"? He has already stated that he wishes to be with me bcos we are so close. Has anyone any suggestions, I have to start my new life and he will eventual have a better life with me in Aus but its killing me just imagining being away from him.
  3. Well I have been hyper since about June when I booked my Son and Daughter in Law's flights to Australia. We have been out here for 14 months now so will be soooo happy to see them when they arrive here on Monday at 7am for their three week holiday. My Daughter JoHatts has not seen her Brother for nearly 5 years so I reckon a few beers will be downed during their time together. They left Heathrow last night which should have been 10.05 but did not get airborn till 10.45 but let's hope they can play catch up and arrive safe and sound tomorrow. My house is spotless as always is and I really don't think I will be able to sleep tonight for fear of not hearing the alarm to get up in time to drive from Sunny Coast to Brisbane Airport. As you can guess I am excited beyond words can say................. Hope everyone has a great 2010.
  4. Hi,we moved over to SA in Sept 08,but couldn't bring our son aged 23 then,as he was of Adult age.Anyway he followed on,on a 1 yr working visa, had a very bad injury, which prevented him from working much,as per Oz Gov criteria.A second year visa for him was not granted. He has now gone home to UK,and is depressed, wanting to be back with his Family,as before. We have perm residence here now.Does anyone know how we can get him back here, and back under the family roof.Thanks.
  5. Could any lovely knowledgable people help please? I'm about to pop out Mr.Small in mid-December in Tasmania. His dad is Australian and I am British on a spouse visa (one year into the two year temp one) I want to take Mr.Small home in June for a holiday. 1) Should I get him a British passport or an Australian passport or both? Does anyone know what he is entilted to? 2) My passport runs out in June - do I need to get the visa again in the new passport or can I just show them the old one in the old passport?

    Son falling behind at school?

Hi guys, Im hopeing someone might have some words of advice? Over the last few months my sons teacher has been complaining to me that my son isnt reaching his full potential and is very "dreamy". she says he is only writing 4 sentences when he should be doing 6-8.. she says he is fidgety and she is constantly having to push him and nag him to get on with his work. Im obviously very concerned, as he is such a bright little boy.. hes only 6 but has a reading age of 8.2years, he comes home from school and tells me things that i dont even know! He is very much into Dinosaurs and the plannets, loves jigsaws (can do them face down).. im not saying hes a genius or anythign but i have a feeling im missing something? His teacher is lovely and used to sing his praises, but lately he doesnt seem to be able to do anythig right.. Some times when I speak to her I get the impression she is implying he has a touch of ADD/ADHD or something.. Im not sure whether he needs to go see a doctor or somethign? His teacher has suggested that she speak to a colleague who used to be a paediatrician.. has anyone else had any similar experiences? Thanks in advance! Lindsey x

Condition deteriated and he is now on a ventilator, eyes fixed, no nerve functions, unable to breathe by himself. 2 CT scans and and MRI scan revealled extreme inflammation and swelling of brain stem and spinal cord. They think he has a condition known as ADEM. Given 3 large doses of steroids but no change to his condition as yet. Am absolutely devasted. Just wondered if anyone out there has had a similar experience and give me some hope. Doctors are very non comittal about his chances. MRI and EEG scheduled for next week.

    Son's 10th Birthday

Hi, Two days after we arrive in Perth it is my son's 10th birthday and I wondered if anybody had any suggestions of a nice day out? - we are staying north west Perth and i'm trying to come up with 'a plan'... we were there last year for his birthday and did a day at Hillarys and then tea time barbie at Floreat beach (play area)... so that was great and I dont really want to replcate it again.... may go to Rotto for the day, but as we have only just arrived I think it would be better to stay reasonably close to home... don't fancy the zoo... any other suggestions would be greatly appreciated. thanks guys. :notworthy:
  9. Hello All Just having a panic and wondering if anyone can help. We have our 175 visas  and are validating as a family in April. My son has an interview at Sydney Uni and is flying out on Tuesday for 2 weeks. I checked with Australia house if this would be OK and they said yes, they even said I didn't need to get him an ETA ( which I had already bought anyway) as an unvalidated 175 visa would suffice. We were not looking for him to validate on this trip, he was coming back with us in April to do the whole family validation. Anyway as he flies on Tuesday I thought would double check ( as I am a little OCD ) and this is what they said: Thank you for your enquiry. When your visa was granted, you should have received a letter explaining the visa conditions. In most cases, the primary applicant has to enter first to activate the visa. Therefore, the secondary applicant (partner or dependent children) cannot activate their visa before the primary applicant. Kindly please contact your case officer who processed your visa to confirm whether this rule applies to your case and whether your son can travel to Australia and activate the 175 visa before the primary appliatn. If you apply for an ETA for your son, this will not solve the problem. This is because you may only hold one visa at one time. In general, more substantial visa automatically overrides any other visa. As your permanent residency visa is more substantial, it will remain in effect and would be activated upon arrival. This would than consequently cause problem should the above mentioned condition apply to your case. Kindly please contact South Australia State Office where your application was processed. Probaly most importantly our visa does NOT have the condition that the Primary applicant must enter first ..... strange but true ! Also he is not looking to validate only take a 2 week holiday. It would happen on a Friday night when he flies on Tuesday ...I am now panicking that he will run into problems at Customs and being 17 and travelling alone will not know what to do!! Any thoughts would be much appreciated Jen xx

    18 year old son

Hi all we have been to a expo today and it went well but we were told that our son who is 18 would have to apply on his own if he wants to come out with us. We hoped we could go as a family. Any ideas guys, i have tried to search but havent found any similar stories yet. Thanks Jason
  12. hi, my sister is emmigrating with us and she is just doing her application. What are her options for her son who is 20 who also wants to come with us?.he is not in full time education. can he go on their 176 visa or does he have to do a separate visa with me possibly sponsoring him? Can he come intailly on a working holiday visa? regards,
  13. Me again My partner and I have a son, who by virtue of his mum being an Aussie - and me a pom - holds both a British and Australian passport. As such, he isn't part of my immigration request as he already entitled to live in Oz and doesn't need to be mentioned as a dependent on my forms. Or should he be? If I do add him as a dependent, does that mean that I also need to get a stat dec from his mum (my sponsor) saying that she's happy for him to leave country? Confused  Thanks again
  14. We are moving over in September 09, my son will be 12 in September 09 and would have been starting secondry school ( year 7) this year in the UK. Is this the case in WA ,from what i have read and understand the school year starts in Feb so will he then start high school in Feb 2010 or does high school start in year 8 which would then mean him staying on in Jnr school another year ? thanks
  15. Hi, just wondered if we can get our son removed from our 175 visa? He was 17 when lodged, now hes 18 and probably be 19 when we go. He works FT now and has a long term girlfriend and he said he dosn't want to go. So has anyone done this and how do i go about doing it? I am with an agent Go Matilda but its been over a month ive asked about this and no one has replied to my emails!! Thanks gillian
  16. Hi We have just recived our visas for permanent residency which we are really excited about and can't wait to board the plane. My 18 year old son is thinking about doing his teaching degree in Brisbane which we all would like as we desperately want him to be a part of our new life too. Can anyone tell me if he will be eligible to get Government loans to support his course, accommodation and maintenance like we do back here in the U.K. Ideally he will live with us to reduce his outgoings by staying rent free. Has anyone got any advice on good universities in Brisbane and how does our point system equate to Australia's point system? Any help no matter how big or small would be greatly appreciated. Thanx

    kidney issues for my son

Hi all, my youngest son has a kidney disorder called Hydronephrosis. He had an operation to correct this when he was 11 months on his left kidney but his right kidney is also slightly enlarged. We went last December to see the surgeon who would have discharged him but as his right kidney is affected we have to see him again this December. My son has had no problems with this since his op or really before his op. We are just about to lodge our visa and i've been looking at other posts on here. Any advice would be gratefully recieved or if anyone has had a similar experience please share it with me as i am getting worried. Many thanks Natalie :spinny:
  18. Visa granted 3rd July and we're full steam ahead - flights booked for 17th September, getting quotes from removal companies, working notice periods etc etc My 19 year old son (who lives with us) has said he no longer wants to come...he has girlfriend etc etc. Not getting anywhere with him - trying the softly softly approach, trying the sweetening approach and now moved on to good old plain bribery! We have asked him to commit to two months - he can come back if it isn't for him (he doesn't know but he will have to pay for his own flight!) OH has told his children - took it really well to be fair, followed it up with a letter reinforcing love etc etc. Now I'm scared.....my son has to come with us as I just can't bare the thought of leaving him behind! I'm getting nervous but know we have to make the move as we won't get the opportunity again! 19. We are so close hoping to be in Perth by Oct/Nov. This whole process started over 2 years ago when my son was quite keen. Now he has loads of friends and a girl friend and he is now saying he doesn't want to go. He is never in, socialising with friends is his life at moment. He said he will come and validate his visa but then come back. We have no close family here for him to live with but he said he can stay with friends. We are doing this for a better life and prospects for him and his 10 year old sister but he's having none of it. Anyone in same situation or gone through this? Any info or advice would be greatly apprieciated. Thanks Tina :arghh:
  20. Just had an email from my agent this morning with the news I had hoped would not happen. My application for the 457 sponsored visa was rejected. My son has down syndrome and the MOC stated Jake did not meet the health requirement. The state the medical opinion is based on potential costs of health care and community service to Australia. Im absolutely gutted and so low right now. Going on the 457 we knew that we had to cover all costs for us as a family as even though we would have paid taxes we knew that everything was for us to pay. Our sponsoring company declined to give a written undertaking to meet any medical costs etc if they were to arise, even though Jake has had no medical condition or need for medical attention in years. He has had no more than a need for calpol in the past 4 years!!! anyway, hope those of you applying for visas with any kind of health condition or disability dont go through this as its the worst feeling you will ever get. Gollywobbler - I know we discussed this before, if there is anything you can add it would be appreciated, but Im not clinging onto any hope here as I imagine if the sponsoring company rejected the undertaken then thats it. Is it worth contacting Dr Goodall again to find out what he said etc?

  22. Hello all Don't know if I am supposed to put this in a different part of the PIO thingy - never mind. My hubby stays at home and looks after our 22 month old son but we want him to go into HOME CHILDCARE, with a few other kids just for half or 1 day a week initially - so he can mix & interact with other littlies and have some fun. Anyone know anyone who is a register childcarer? We live in Arundel. lol Lesley:biggrin:X bump
  23. Hi Everyone Just a quick query ( more of a concerned afterthought really) ! We have booked my 17 year old son a flight to Sydney in October to visit the Uni and take a mini reccie. He is going with his 21 year old cousin and staying with my brother. Being honest its a selfish move on my part as I don't want him to stay at Uni here and I am sure that 2 weeks in Sydney in Summer will convince him coming with us is the right move! Anyway we are hopeful of having our visas well before then but are not looking to go out until next year. The concern I have is if he has the visa in his passport but we have not validated as a family, will it give him any problems at immigration? Thanks for any advice Jen x
