  1. Hi all, I have a strange dilemma about my visa subclass 100 myself and my son were granted from offshore. My wife is an OZ citizen. The initial entry date of our visa is due to expire at the beginning of December 2020. All our flights we had booked this year have been cancelled by the airline due to the ongoing covid situation. I can prove that with cancellation certs issues by the airline. Technically, we still have some time left but when I called the airline to rebook after the last cancellation , they explained to me that the OZ government would only allow people to fly to australia for "emergencies".The airlines are told to enforce that policy and they need to actually engage with the OZ goverment before allowing a passenger on a flight. As "emergency" they have 3 categories that fit into it: 1. OZ citizen going back for medical emergency 2. OZ citizen stuck abroad with no means to support himself/herself 3. Family member stuck abroad with a child to care for in OZ. Clearly, (and rightfully so) our partner visa activation doesn't fit into any of that so I have no hope to make it to OZ by the IED. On the same line, it's clear that this is totally out of my hands and it's the australian government that has set this priorities. The Department of Home Affairs have been pretty generic up to now when i enquired. According to them the message is that there is absolutely no leeway in postponing the initial entry date. is anyone in the same situation as myself and how did they handle it? I would be interested to know if anyone got an extension to their IED based on the current Covid situation and how they went about getting one. Thank you very much to all
  2. I have two questions. My partner is applying for the Australian 476 graduate visa and I am included as the dependent. Will I have the same working rights as my partner for a job or will I have any sort of disadvantage. We are both equally eligible for the 476 visa by the way, with same degree and qualification. But we decided to apply together under one visa. Do you think that is the right thing to do or should we apply individually?
  3. Hi everyone, need some advice on PR pathways please. My partner and I are currently living in Melbourne. both of us are on 485 (Temporary graduate) visas. My visa expires in April 2021 and partner's visa in April 2022. I will be the primary applicant (IT Systems Analyst). I'm currently in the process of gathering documents for an ACS skills assessment. Post a successful skills assessment by the ACS, I plan to apply for an EOI for subclass 189 and 190. In the event that I do not receive an invite before my visa expires, what are my options ? option 1 - Can I jump onto my partner's visa (we are in a de-facto) using the subsequent entrant visa? This will give me an additional year in Australia till my partner's visa expires. If proving a de-facto is difficult (we have been together for ~3 years), we anyway planned to get married once the situation improved. We can pre-pone the marriage registration and then apply for the visa(if that's easier than proving de-facto). Is there a rule that we have to be married for certain years/months before I apply for a subsequent entrant visa? option 2 - Jump on a visitor visa. Do not prefer this option as I would have to leave my full time job. Are there any other options I have ? You help and any advice will really be appreciated. Thank you!

    Husband left Australia on Bridging Visa A

    Hi, my husband is Papua New Guinean and recently left Australia to return home to be with his family during Covid. He has been in Australia on a Partner VISA and was granted this along with a Bridging visa A earlier this year. We never applied for a Bridging Visa B before he left to go home. We have a 21 month old son and we don’t know when my son will see his dad again. We were hoping we could fly him over from PNG for my son’s 2nd birthday and Christmas but am not sure if this would be permitted. A) due to Covid and not knowing who is allowed to enter and B) because he left the country without applying for a Bridging Visa B. Is there anybody in here who can shed some light on this for me please? Thank you in advance. Nicole
  5. Hello, As the de-facto partner of a NZ citizen residing in Australia, I am considering to start an application for a 461(New Zealand Citizen Family Relationship) visa. I am concerned about the very lengthy period (two years) it takes to be approved. I understand that I will get a bridging visa during this period. Will I have work rights while on this bridging visa? Also, Immi website says that if I apply from Australia I have to be in Australia when they make their decision. What happens if I leave Australia while the visa is being processed? Is the process cancelled? Thanks!

    How AAT Review Works

    I am silent follower. my 309 and 100 visa was refused and did appeal at AAT. AAT gave priority 1 in February, 2020. Its been more then 6 months now my case did not allocated to a AAT member yet. I have an agent. My agent sent several email to AAT about the update but AAT replied to wait and they (AAT) will inform us when our case been allocated to a member. I am still waiting. If anyone have any information, advise or help I would be very grateful.

  8. Hi, new member here. My apologies if some of these questions have already been answered. Im filling out, day by day, our 309 Visa to return to Australia. My husband is an Australian Citizen by birth, I am British. I have some confusion as to who can fill out 888 forms. I thought it was only Australian permanent residents or Citizens. But I have been told that my family and friends in the UK can fill them out also. Is this correct? If it is not, what are the alternatives? And, I am in a bit of debt with my bank in Australia. This is due to the speed in which I had to leave the country as to not overstay. Do you have to pay your debt off completley or can you prove you are repaying it in manageable amounts in order to have your visa approved? Thank you in advance!!!

  10. Hi all, I applied for my partner visa on February 1st, 2019 and now would like to apply for my permanent visa subclass 100. I know usually 2 years should have passed since i applied for 309 to be eligible for 100 but I am currently enrolled in a university and until I have the subclass 100, I have to pay the International fee. If there is a way for me to apply for my subclass 100 permanent visa just a few months earlier, I could make it just in time to enrol as a domestic student next year. So, does anyone know if I have a compelling enough reason and how to apply for Subclass 100 just a few months earlier than 2 years? If I try to lodge the online application, it asks if it has been 2 years since I applied for subclass 309 visa, so I have to select No, which then prevents the application from being sent through. Would it be a good idea to send in the paper application instead to see if that would be accepted?
  11. Hello! I'm finishing my 801 application (I obtained my 820 in 2018) and I'm ticking off the list of documents to provide. My question concerns the stat decs. Now with my 820 my partner (the sponsor) and I each wrote a stat dec in "free form": we did not use a form or template, we just wrote a letter explaining the relationship and focusing on the four aspects - social, financial etc - that Immigration requires. But I see there is an official form for the sponsor (https://immi.homeaffairs.gov.au/form-listing/forms/stat_dec_sponsor.pdf) and I also read somewhere that a stat dec is not required for the applicant for a 801 (is that true?). My question is: is it better to ask my partner to fill the form rather than writing his stat dec, and do I not need to fill mine? Thank you very much!

  13. Hi all, First time poster here. I’m currently on a tourist visa which expires in September. We applied for my partner visa (from Australia) last month. My BVA doesn’t activate until my tourist visa expires. Is there any way to get it activated sooner? My partner’s work has been affected by the coronavirus and it would be great if I could start looking for work. TIA!

    Partner visa advice!

    I haven't been with my partner long (only a couple of months officially) but we have been talking about the future. I was hoping someone could give me some advice. He is seperated and has been for a few years now. They have a child but live in different towns (4 hours away). He is Australian. I'm from the UK over here studying. My student visa expires March 2021. Literally a few days off the 12 month requirement. I am thinking of studying further but course limitations for International students make it hard to do where we live so I might have to move. We haven't moved in together yet but are planning to. Can anyone advise whether we would realistically stand a chance of a de facto visa? I know registering the relationship would help with the time limit but my understanding is we cant get that as he is currently married. Kind regards and TIA!
  15. First post here so hello all! I've basically joined to share my woes and hopefully gain some reassurance or useful knowledge whilst going through this process. I feel as if I am fast approaching a crossroads in my visa decision making so it will be good to talk it through with someone. I'll make this into a short easy to read timeline of my journey so far - Aug 2016 - Aug 2017 - Completed WHV (met gf in Jan 2017 and started dating) Nov 2018 - Skills assessment approved after a long laborious process. EOI Lodged for Engineering Technologist 190 VIC - 65pts. Jan 2019 - GF moves over to UK with 2 year WHV after over a year long distancing. June 2019 - EOI lodged for Engineering Technologist 189 - 65pts - Updated 190 VIC - 70pts (had to wait for 5years experience for these 5pts) *Since Jan 2018 I have taken x4 IELTS/PTE exams where every time I have been 1-2 marks off Superior English. Example - Spkg 9.0 / Read 8.5 / Write 8.0 / List 7.5. (I have another booked 7th March.) Current Stats - 29 years (30pts) / IELTS (10pts) / BSc degree (15pts) / 5-8yrs Overseas Experience (10pts) / Single or Citizen Partner (5pts) = 65 or 65+5 190. Obviously its imperative I gain those extra 10 available for the English exam asap but even so I think I'm in danger of not be granted anything before the year is up and she has to return as 75 or 75+5 doesn't seem to be cutting the mustard currently... So...Option A is we move to NZ at the end of 2020 and I use my WHV whilst we wait for it to be granted. (but will be EOI's run out by then)? Option B In conjunction with 'A' we turn to Partner Visa of some kind (marriage/proposal is a strong possibility irrespective of this visa situation)(shes waiting for a ring!). But still the processing times are ludicrous and who knows how that will go. Linked to this would a fiance 300 visa work for me to at least enter and be able to work with staying with her? I will be discussing this with my agent of course but any opinions or advice would be most welcome. Cheers, Alistair.
  16. Hello everyone! I lodged my partner visa application for my wife on 27th January 2019.....got all medicals and biometrics done on 12th Feb 2019 and front loaded all documents....... My wife got an interview call from the embassy on 11th Oct 2019 while she was on a family sponsored visitor visa in Australia... after the interview I the sponsor got a RFI for Online form 40sp and Updated PCC of sponsor..... we submitted all documents on 26th Oct 2019 and pressed the I confirm button as well..... But we haven't heard back from immigration ever since..... furthermore my wife made an exit too from Australia on 22 of October as her tourist visa was expiring.......I'm a Australian PR and our application is being processed in AHC Islamabad ,Pakistan......The average times that most people got visas in our home country are 9-12 months...... but they did got calls for second RFI's.............what worries me that I haven't heard back from them ever since? Can anyone advice is this normal.....and how much more do I have to wait. This is really stressful.
  17. Hello, I am new to the forum so in advance a warning I am not familiar with all that I might be asking !! We are currently considering an application for Partner Visa for my husband of 7 yrs. He is English and I am Australian. I have lived out of the country for 19 yrs now. We are concerned with the application due to him having Rheumatoid Arthritis and being on a medical infusion every 6 - 8 months. I am aware of the cost of this medicine in Australia and also the others he has to take like anti inflammatory drugs and others needed. My question is ... Has anyone else had Health issues they have had to deal with in their application - I am most sure they will query this in the Basic Medical side of the application as it is an ongoing illness. If so how successful have people been either keeping within the $49 000 costs for 10 yrs they state. Or if they state you will exceed it what are the chances for a successful application. This information might help our decision to pay for an agent to walk us through the application process and for any future appeals for this. Thank you for any advice in advance. xx
  18. Hello guys! I needed a bit of advice I lodged my partner visa application on 15th Jan 2019 for my wife 309/100 and I am currently on Australian PR. We have been married for over a year now got married in Nov 2018.During this time I visited my wife in Pakistan back in March and then invited her on shore on a family sponsored visit visa in July which was valid for months. She stayed here with me from July- Oct. On 5th October we wife got a call from immigration(AHC Islamabad) while my wife was in Australia and she was interviewed the normal spouse interview that happens in which they asked her about her name,DOB,my name ,DOB, marriage date, our future plans,our daily routines etc. After her interview I the sponsor got an RFI for online form 40sp and my updated PCC's.....I fulfilled all requirements and submitted all documents on 20th October....My wife returned back to Pakistan in end of october.....I then re visited her in December 2019 and flew back in January........... then on 10th January my wife again got a follow up interview call from the AHC in which they said that there is an allegation against you and your husband that your relationship is not genuine and continuing(and that is the reason why your case is suffering delays ......like normal applications in our home country get processed in 8-12 months) .....is this claim true? My wife answered that this claim is baseless and definitely there's no truth in it giving all reasons that how she and I have constantly been in touch and visited each other throughout the year and plus we have over 400 photos us together uploaded on our immi account with friends,family of get togethers,social events,birthdays and what not both in Australia and Pakistan with proper dates and even all our wedding pictures. The interviewer assured my wife that yes I have seen all these proofs and we don't really give weightage to these allegations we just wanted to here about your stance....After a gap of 2 hours I also got a call from the AHC and was asked similar questions about our relationship in specific,routines, where my wife is living currently , how I would describe my relationship in one sentence,our future plans etc. Has anyone ever been in a situation similar to ours where someone has levied an allegation against their application and if so then how long did the case took to process? Does anyone have any idea that how long will I have to wait more either for a grant or ultimate refusal even though I believe that we have sufficient proof on our application that our relationship is genuine and continuing(We even purchased a family car,a home on rent in Melbourne, furniture and attached all utility bills of the 3 months me wife was living with me in Australia, bank statements of all the transfers I made when she's in Pakistan,shopping receipts, trips we went on,travel itineraries,and bank statement of our joint account in Australia). Any advice or help will be highly appreciated as both me and my wife are extremely devastated after these interview calls even though no decision has been made on our application but such false accusations on such a genuine relationship are heart breaking.
  19. Hi there, I am new to this forum and would firstly like to say thank you so much for all of the advice that is already out there! I have a question about form 888 for the offshore partner visa and haven;t been able to find the answers so far. My partner is Australian and I am English and we currently live in the UK and are applying for the visa from the UK. We have asked 3 family/friends in Australia to complete form 888 for us, and 3 family/friends in the UK. My questions are specifically about form 888: 1. One of our friends in the UK is actually an Australian citizen (here for 2 years), so is completing the official form 888 for us. I am confused as to who can witness his signature to ensure it is considered a legal document in Australia. We have a friend who is a nurse but is a UK citizen - could she witness this or would he need to take it to a solicitor/notary? (I would rather avoid causing extra work for him or him being out of pocket if possible!) 2. I have read online that all documents don't need to be certified as long as they are scanned as good quality, colour copies. Is this also true for the passports of those who fill out the form 888 (both in Australia and the UK)? 3. For our UK family and friends, they will be making their statement on plain paper and signing and dating. Do their signatures also need to be witnessed, and if so I am really struggling to find concrete information on who can witness this. Thanks for any help you can offer - this process truly is a headache!!

    partner visa Aus to UK

    Hi, i am (dual citizen - UK/Aus) getting married to an Australian later this month and then we want to apply for the partner visa so we can return to UK to live/work. I have a written conditional job offer earning enough to cover requirements - is this enough to apply for visa or do i need to wait for police check/references to return? Also i applied for 189 visa myself and found it easy without any help, is the partner visa straight forward too or do you think we should pay someone to help us? Any idea on time frames for visa and can we return to UK before his visa is issued on a visitor visa? Any info appreciated. Thanks
  21. Hi Friends, I need your help with what visa to apply for my partner. I am an Australian citizen and she is Nepalese. We first met in 2014 in Sydney where we studied together. She went back home in 2016 as her visa expired and she couldn't complete her points. We have been to Thailand tour in 2018 and I visited Nepal early last year where we got engaged. We have loads of pictures and conversations together since the time we met. Unfortunately, when she was here we do not have any shared expenses like House rent and bills as she stayed with her cousins. We plan to get married this December in Nepal and I want her to be with me in my return back to Sydney. A few options that I could think of are as follows: 1) Apply for a Prospective Marriage Visa and do a court marriage within the 9 month time period. However, I am unsure if she would get her visa by this December when we plan to marry in Nepal.. 2) Marry in December and she travels with me here on Tourist Visa. Once she is here we do a court marriage and apply for Partner visa so she can go into Bridging and continue staying here.. I am just confused and would appreciate some help. Thank You!

    Partner Visa break up!

    Hi guys. Long time lurker over many years, you guys have helped me out numerous times in the past. I just want to ask, I couldn’t see anywhere in search bar, what’s the best thing to do if a partner visa couple breaks up? Im originally from UK, she is Australian. We met in 2012, engaged in 2015 but have called it a day recently. I just wondered if there was a procedure I may need to do and how it effects me? Argh!   23. Question: I applied for a partner /spousal visa 100/309 in the UK in sept 2019 But I will be going to Australia to work on a 407 training visa in Jan 2020 . Do I need to be in the UK to have the partner visa granted or can it be granted whilst I am residing in Australia ??? I've paid up for the 100/ 309 . really hope I don't need to apply again in Australia for the 820/801

Has anyone uploaded emails as evidence of relationship and communication for the 100/309 Just wondering what the best way to do this is? shall I just copy and paste emails onto a word document or is there a clever link to transmit lots of emails? grateful for all info and other tips on evidence upload too
  25. I'm applying for the overseas spousal visa (300/309) and need 2 relationship witnesses. Can some tell me how this works as it's not clear on the immi website. Do two friend just write a statement on a bit of paper for example or is there a form?
